My soon to be ex wife fled Alaska with my 7 year old daughter and enrolled her in this school. She is breaking court orders and lying to our judge in Alaska, claiming she had not moved to California. Judge doesn't believe this has happened and denied the motion for my daughters immediate return because the attorney for my ex claims she is "just there on vacation". I cannot get anyone from Leffingwell Elementary to answer their phone or return voicemails to confirm enrollment. Do any fellow arfcommers have a contact here that I could speak with? Or that they could contact and encourage them to call me back? We have joint 50/50 custody and equal decision making. Grasping at straws |

I am on the completely opposite side of the LA Basin, so I cannot help in any way. I know no one there and know nothing of the laws that apply. I am only responding to let you know SOMEBODY read your post. Good luck in resolving your difficulties. Children are precious. |

Their attorney refuses to provide a return date. |

I do know California protects minors, especially so for students. It would likely take a letter from an attorney with "power of attorney", on official law firm letterhead, and/or a court order to get her enrollment status. This is just a guess - if your daughter gets enrolled, she would lose her legal status as just being "on a vacation". If your wife rents an apartment, California will consider her to be a legal resident and no longer "on a vacation". Given this load you have to deal with, you have my sympathy. As turbolarry says, we're not lawyers. Talk to your attorney for legal advice, not to us. |

I'm not an attorney, but if there is joint custody you should probably be provided a return date if they are out of state. Document all phone contacts with the attorney requesting a return date. Save all emails and replies about requesting a return date. If you do not get a return date within two business days, then go back to the judge with your documentation. That's what I would do. Hopefully it's not the worst case scenario and you don't have to build a case. |

Blatently openingly violating the judges orders. Filed a DV protection order this morning for my daughters immediate return since she is commiting a felony in Alaska by doing this. Judge denied the order, and instead scheduled a hearing 5 days before her school starts. The order says my kid must be given back to her 2 weeks before school starts. The insanity of family court is beyond my comprehension. |
