So an out of state dealer is shipping a rifle to my FFL. The rifle came with a suppressor from the factory. The dealer is shipping the rifle to my ffl/gunsmith. My FFL said he will replace the suppressor with a compensator/brake so that the rifle is NY state compliant. Has anyone ever done this before (I.E. had a rifle configured from the factory that was not new york compliant shipped to NY and made NY compliant?) My question is : Is the firearms serial number registered as a non-NY compliant firearm regardless of whether or not my gunsmith alters it so that is NY compliant? Im just worried that even after swapping a compensator on the rifle, it will still show up as not being compliant and still cause an issue, even thogh my gunsmith/FFL altered it so that it is. Are individual rifles serial numbers registered to the specific make and model and flag as not being a NY state compliant rifle? Or is it simply just a "long gun" with a serial number.

| Sounds good. Ive had FFL'S tell me that its not possible because the rifle is registered as non NY compliant and the company themselves told me I have to get the model with the compensator put on "by the factory" was there exact response when I asked them the question about making there suppressor version NY compliant by having a comp perm. fixed on there. |

Don't worry about it.
I doubt you'll get in trouble for whatever muzzle device is on the end of your barrel. Hell, since the federal AWB lapsed in 2004, the ATF doesn't "officially classify" muzzle devices as either a flash suppressor or a muzzle brake anymore, and the NYSP relied on the ATF to make the distinction, so now a lot of new muzzle devices (Yankee Hill Phantom) aren't classified and won't be (unless there's a new federal AWB) |

Muzzle breaks where named as banned features in HR 1022, and it didn't allow a single evil feature. |

In the 2008 AWB passed by the NYS Assembly (but died in the Senate) pump action rifles and .22 caliber target pistols with a brake or compensator would be banned as assault weapons. |
| I really wonder what there logic is behind that? I just don't understand what they believe is evil about a compensator or brake, I just dont get it. Im having some serious issues find a comp or brake right now though with 15x1mm threads for my ptr-91. Hk91 clone. Im trying to find out if its possible to rethread a muzzle attatchment to fit the threads on my rifle. |

There is no logic or sense to be understood. It's nothing more than a "step" in the process to ban all firearms in NYS. The fact that the only guns that will actually banned will be those possessed by law abiding citizens. Criminals of course will simply continue to ignore these laws as they have always done in the past. The end result will be more gun related crime and not less. |
