Hey all,
So it's been a while since I moved out of CA.  2 fast questions regarding pistol mags:'
- 10 round mags are fine to ship into CA, correct?
- Second, my dad sent me a pistol (from CA, to me in VA, via FFL) that had a 12-round mag.  Can that magazine be (edited for clarification) shipped back to my Dad?

10 round mags are fine

importing a +10 mag is a nono... you are not the one who had it here originaly so it is a nono... take it apart and turn it into a parts kit and leave it apart or block it to 10 rounds

Right, but if I gave it back to my Dad, who did have it originally ...

Seems like it's a bit fuzzy to me. Probably should change my OP to clarify.

A high capacity magazine is free to come-n-go from California as many times as it likes and and stay gone for as long as it likes. In your case your father's pistol magazine is free to return to his possession. It couldn't be, say, returned to me rather than your father though.

Since the burden of proof is with the government, there are no serial numbers on magazines, and those non-existent serials numbers are not recorded on receipts nor in any other way the law becomes stupid and useless and damn near impossible to enforce in many many instances.

I figure I also have a moral obligation to disobey unlawful/un-Constitutional laws.*

*(Not that this is one of them nor do I ever advocate the commission of any illegal activities.)

Seems this would apply to your father...

Penal Code 32420
Section 32310 does not apply to the importation of a large-capacity magazine by a person who lawfully possessed the large-capacity magazine in the state prior to January 1, 2000, lawfully took it out of the state, and is returning to the state with the same large-capacity magazine.

Sorry to digress but say I wanted to sell someone a rebuild kit. As long as it was all taken apart ( body, springs, folllower, and end plate, dust cover) and it was shipped to them in CA as such each part in its own package. Is this the way to do it?

Yes, it is currently legal to do so.

check TSA on that... its been a while but last time i flew with a firearm i remember i think i remember reading something about "firearm parts" or something.... better safe than sorry
