I'm sure this has been discussed before, but what are the legal issues with making a gun, from scratch?

The way I've always understood it, is that I can make an AR15 lower for instance, make it a fully functional gun (non-full auto) and use it all legally......I just can not sell it.

I'm also assuming I can't make it into an SBR, as that would be NFA.  And I understand all NFA stuff to be a no-no in this same scenario.

I have an idea on something I want to make, but have been getting the 'OMG, you'll go to Jail if you make a non registered gun'  Gun registration always makes me laugh.

Except for the "you can never sell it part" you are correct...

You can eventually, if you tire of it , sell it. What you CAN NOT do is make It TO sell. If you make it and sell it a week later , BATFEces could easily argue you made it TO sell , putting you in the "business" of manufacturing firearms .....

If you make an SBR, you have to register it. So you are better off just buying a lower, besides the custom serial number.

If you sell it, you have to register it as well, I am not sure how this works through inheriting though.

If you want to sell it in the future, just buy a lower and keep the one you made.

So, you can make a lower, and do whatever to it, you just need to register it, which in some cases defeats the purpose, if your tinfoil is on too tight.

There is no registering involved if you sell it. If you SBR it, you have to register it, then if you sell the SBR, you do a transfer.


ETA: to clarify, If you machine your lower, use it for awhile and decide to get rid of it, you don't need to register it. If you SBR that same lower, then it needs to be registered on the form1/4 (not sure which it needs).

I'm sure the NFA guys will be along soon to make any corrections.

I thought you did.

I guess when I was researching, you couldn't have someone make it for you, pretty much implied you couldn't dispose of it without proper paperwork.

I guess I heard wrong.

It just means what it says, you can't go to a machine shop and ask them to make you a lower. You can mill your own, and you can sell it in the future if you want to and treat it just like any other firearm.
