10-23-2008, submitted Form 1 to get "AOW" status for my SP89 type clone. Approx 6 weeks later, I called NFA Branch to check on my Form 1 status. Tech could not find my serial # in the database. After digging thru my stuff, I found teh photocopy of the original form 1 and discovered that I had accidentally added an extra digit to the serial # block.

I was transferred to my Examiner and I explained to him what the problem was and gave him the correct serial #. He stated that he would take care of it on his end. I assumed that he would either change the form himself or mail it back so that I could make the change and then return it to him.

Not the case. I received my approved Form 1 back yesterday, incorrect serial # still in place. After waiting this long and not knowing what the hell the Obamanation will do to NFA processes in the future, what are my options?

I assume that I can't alter the serial # on the receiver to match the Form 1 despite the fact that I am considered the Mfr. ....correct??

Any input will be appreciated.

Sounds like your examiner dropped the ball, with as much work as they have right now it's understandable but that doesn't really help you.

I'd suggest contacting the examiner by phone and explaining the situation, he may have made an annotation on their copy but it wouldn't do you any good if someone were to look at your form 1.

If he's no help I have the number of the local ATF compliance investigator if you want to try that route.

And I wouldn't AOW the SP89 until I got all this straightened out.

I am curious though, why AOW over SBR?  It's the same $200 "manufacturing" tax and you can install a VFG onto a SBR.

Well I already SBR'd 2 of those type weapons and I was just being anal by wanting an AOW.


Anyway, I just got a hold of my examiner and apparently he realized that he had indeed dropped the ball and gave me 2 suggestions:

1. Return the Form 1 along with a letter explaining the serial # issue. he would make the adjustment to the Form 1 and issue another stamp with the correct # written on it.

OR

2. Engrave the extra digit to the receiver myself since according to NFA I am now the Mfr. of said weapon.

I don't think I'm gonna go with option # 2.

Dude,

If it where me.  I'd go see Shawn over at AccuLaser, and have the "1" engraved.  Take the paperwork with you, and explain that your the manufacturer.  He'll understand.  His been around us enough.  That would be the simple thing to do.  You wouldn't be wasting anymore of your time, and the examiner would be happier as well.  You'll be out with your new AOW in a matter of hours, or days, and not months!

EDIT:  THIS IS A "NO BRAINER", at least to me.

Well I just spoke to the resident agent in charge of the SGF ATF office (who is in fact the biggest A-Hole I have ever encountered, the prick treated me like I was a fucking  perp......as if a criminal would be asking what was the right thing to do).

- he basically stated in a nutshell that altering the original serial # was against the law and that the Form 1 should be sent back.

I would not mess with the original s/n, that will get your ass in a sling.  That is not a good idea.  Just send them a letter with a photo copy of your form 1, explaning the problem and asking them to update their copy of the form 1 and the NFA database to the correct s/n.  Ask them to send you a letter noting the correction had been made.  You can attach to your form 1.

This is what I would do. Since one must engrave your name, city, and state, I would also have the serial number on your approved form 1 engraved on the weapon.

10-4 I did that at lunch. It just pisses me off that the right hand of the ATF doe not know what the left is doing or is supposed to do. It's like there is no uniformity to what they do unless it's coming over to take your damn guns.

When "making" a new firearm, as when you "make" an NFA firearm out of a Title I gun, you may give it a new serial number.  ATF asks that you reuse the original number, but there is no law requiring you to do this.  I have seen a number of NFA firearms that were registered with a new number.  The gun now has two serial numbers, but usually the NFA paperwork will only reflect the "new" s/n.  

Sub_MG is correct advising not to mess with the original number, as there are laws regarding this.  You can add a new number, though.

Well the ATF came thru for me within 10 days. I mailed off the Form 1 along with a letter explaining the problem and  I got it back, edited and a new tax stamp attached.
Woohoo!!!!!!!!!!!!!!!
