I am interested in eventually building an SBR and perhaps buying a suppressor. I am living in Fairfax and have a couple basic questions for you guys who have some NFA experience.

1. Trust or individual? Is it easier to get thru all the paperwork working as a trust or an individual? The advantages I can see for forming a trust would be to expedite the paperwork for individual items and perhaps manage the items more efficiently later on.

2. Also I am planning to join the military within the next 12-18 months. Would it be smart for me to form a trust with myself and someone else such as my father? I am not quite sure how the possession of NFA items works but I am thinking that I won't be able to just drop off a couple SBRs with a friend or family member while overseas or out of state. My logic is that by forming a trust with my father I would have a ready NFA babysitter.

I believe Fairfax will sign off so going the individual route would give you the least amount of paperwork. May or may not take extra time as far as the atf approval goes.

Having someone like your father on the trust paperwork is a nice option. The key is access. Put a small safe in his house that he doesn't have a key or combo too for the sbr and supressor. That way he doesn't have direct access if you go individual.

Does anyone have any experience with the process in Fairfax county? Is most of the wait time with the ATF? I figured that the law enforcement sign off wouldn't take very long.

Yes most of the wait time is with the atf. Figure 3 to 4 months door to door when you send it to them. Some will take less time(people have been seening form 4 transfers in 60 some days) while some will take longer.

Not sure how long fairfax will take to sign off. With some areas you just make an appointment and meet with the sherif to sign. Others have you mail everything to them and will get it back to you in days or weeks. I believe fairfax is the later based on what I've read here but I have no first hand knowledge.

I have not done any NFA business with Fairfax County since 2006, but at that time, they were very easy to deal with.

IIRC, I just had to build a packet of all of the information that they needed, and drop it off at the Sheriff's office.  They would then conduct a check and send it all back once complete.

They required the same information that the ATF required, so I sent them everything that I was going to send to the ATF.  This may have changed since then, so you might want to call to be sure.

Note:  Be sure to print your ATF forms on both sides of the paper.  My first form was returned, because I printed it on two seperate pages.

FWIW, I was really impressed with their process, and how professional and easy they made it for me.  YMMV.

Fairfax signs. Length of time depends on how bizzy they are. The Sheriff Office IA section deals with this and there are only two people in that office and signing these forms is not their only thing they do. Mine have been back all with in two weeks or less. Check out this webpage for more info....look at the section at the bottom right "class 3 firearms". http://www.fairfaxcounty.gov/sheriff/.


However based upon your situation a trust maybe a better choice for you.

How did you form your trust? Did you go to an attorney or do it yourself with something like Quicken Will?

I just used Quicken Willmaker and have 2 stamps in the trust already.

The NFA section in Martinsburg advises that they have run into problems with some of the trust documents sent to them over the past several months. As a result, all trust documents are sent from Martinsburg to Washington HQ to be reviewed by the ATF legal department before any transfers going to a trust are approved.  You can count on this process adding at least a few weeks to the time it takes for approval.

As an aside, I'm in the process of selling an MG, and am somewhat surprised at the length of time it is taking for approval to come through. The form 4 was sent in on May12th, it went pending on June 21st, and I have been told to expect a 4-month process time. This will make it late October before the approval comes back.

When I bought the gun in 2007, the approval took 27 days door-to-door.

Hmmmmm. I wonder if the current administration has anything to do with the extensive amount of time it now takes for approval. Nahhh. Must be my imagination.

For anything legal relate I would use a lawyer who specializes in what you are trying to do.  Yeah sure Willmaker may do it for cheap but when may be potential legal / tax implications later down the road you'll be glad you spent a few hundred bucks.  While I don't pretend to be a lawyer I am married to one and she is very vocal in using a professional to do our paperwork.  I don't know specifics of why or her experiences but I do trust her and she is very far from anti gun.

FFX signs, get your cards from the ATF, take them down to the Central Records Facility on Paige Dr, pay your $15, then walk next door and hand in your packet to the Sheriff.  I did 3 stamps at once last year and it took about 4 weeks to get them back, then took another 5 months for the ATF to approve them.

I've been mulling a .22 suppressor for some time now. I think I've settled on an Outback II.

Virginia Arms in Manassas had Gemtech Alpine in stock as of yesterday.....Guns and Ammo Warehouse also in Manassas had the Outback 2 in stock a couple weeks ago––not sure if they still do. Both are good shops to do biz with.

EDIT––-Loudoun Guns in Leesburg also had an Outback 2 but its been a few weeks since I was there so I can not say for sure they still have 1 in stock.

Good choice. I've got an Outback II and am very satisfied with it.

Loudoun Guns had one in the display case yesterday when I was there.
