Hello all, in need of some help. I am a Marine, stationed in California, but home on pre-depolyment leave here in Missouri. I want to get the ball rolling on some suppressors and an SBR, so the approval process can be spent while I'm overseas. I've decided to use the NFA trust method so that my parents can keep and use my nfa items while Im away. So today I walk into the local class III funstore and strike up a conversation with an employee, who I think is the owner. I outline my plan and he tells me that when the ATF audited his shop they said they were planning on doing away with the trust method because it was an easy way for multiple people to have access to nfa items. So what I'm asking is, has anyone else heard of this? Anybody applied for a suppressor using a trust, in Missouri lately? Any help for this dumb grunt is much appreciated. I've crossed posted this in the Suppressor section in the Armory. Thanks for any help. |

There has been a lot of discussion, conjecture, and hearsay on potential changes for trusts and corps w nfa items. This is the only proposed administrative change I've seen http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201210&RIN=1140-AA43 |

Last I read it would require everyone on the trust to do the same things as required in an individual possession. I.e. the trust remains but if 3 people are on the trust, all 3 people need prints and photos. Its possible they could prohibit trusts all together. |

To me that negates the usefulness of an ""NFA Trust" as far as for what I got it for.... |

Oh I'm sure, but it technically circumvents the intent of the law and so until GCA '68 is repealed or modified, its an inevitability. Its not an argument of whether the law should exist or not, its the fact that the law requires certain criteria to be met and if those criteria can be circumvented it really is a 'loop hole' in a sense. Its a justified move in this case if you adhere to the law as written even if the law itself is unjustified. The battle should be focused on repealing the law all together rather than seeking some middle ground to appease certain groups of people. I would say states favor the law as it cuts down administrative costs due to the ATF handling all of it rather than each state using their own funds on it. Its crappy, but that's the mud we've gotten ourselves stuck in. |
