I was born and raised in the central valley and sense joining the military in 2002 have not lived in the state. Due to advancement I may be transferring back to California this year. My wife and I want to be close to family. This is where I run into some issues. In my travels outside of the state I have accumulated some rifles. I know with my Spikes I can throw a bullet button and a 10 round mag on it and be good to go but another rifle I have is a Bushmaster. I read in the primer that if I am active duty pcs'ed to the state I can keep it with a permit. Trouble is I cant find any info on what that permit is or how I would go about getting it.
If anybody here has been in this position or a similar one before please let me know what you did. I figure worst case is I sell the Bushmaster here (michigan) before I leave and build/buy and off list gun to replace it but I dont want to go through that if I dont have to. Thanks |

What was your state of enlistment/home-of-record? The MAWP applies only to those folks who enlisted from the other 49 states. Worse case is you'll have to spend $100 and buy an off-list lower. Paul, not to steal thunder or anything, but I am a native that enlisted here out of high school. I PCS'd to San Diego from San Antonio and filed the MAWP application making it perfectly clear that I am a resident, and I was still granted a MAWP for my Bushmaster. I would call the Department of Justice to make sure. I would also recommend reading Paul's prolific thread that is tacked at the top of this board. Also, keep in mind that the MAWP is only good as long as you are on active duty with orders for CA. So, if you are no longer active duty or have orders for another state, you need to move the firearms listed on the MAWP out of CA. What about making them not assault weapons such as installing a BB on an OLL that was registered with a MAWP? I ask because I have an OLL on a MAWP and will be retiring in Jan 2011 and will remain here in Cali thus becoming a Cali resident. Anybody have any experience with this before I call the DOJ for clarification? |

Box 820200 Sacramento, CA 94203-0200 I hear you, I wanted to ensure I was in full compliance and made it expressly clear to the woman that I was born, raised and would probably eventually retire here and she said no problem. Hopefully if they were wrong the fact that I have paper in hand should save me. I keep a copy of that damn thing with the rifle. |

Anybody have any experience with this before I call the DOJ for clarification? This is what I did. When you retire you are required to write them closing out your permit. I don't recall the exact language of the requirement. What I did was remove some weapons and keep one changing it into fixed magazine top loader (FAL). And wouldn't you know that the 10 or so ARs I owned they were all on the list so I ended up buying some more OLLs to go with all those uppers. I've got friends and family in several states watching my stuff. |
