I live less than 10 miles from the NC state line on Buggs Island lake or what you call Kerr Lake & I need your help. Is there anyway I can find out if a NC resident has a criminal record that would prevent him from possing a handgun? Free if possible, I'm cheap! This person lived in Rockingham County/ Town of Eden when he was arrested some years back. What became of his arrest was kept from me. He is now going to college in Greensboro.

I believe if you live in VA and this person lives in NC you must go through a FFL to make it legal. The face to face sale is a no go. Edit to add this: Mike You didn’t state any were in you post if this transaction was a face to face or if you guys were going through a FFL dealer. But if this person sends you the money for the gun and a signed copy of an FFL dealer in NC via fax, email or sail mail, then I would go ahead and sent the gun to that dealer in NC. That way it is between the FFL dealer and that person not you. Plus when I do a local in state face to face sale I ask the question "Is there any federal or state law that would stop you from owning this gun" |

What is going on is that my dad passed away Saturday. He has several long guns & 2 handguns. So far we haven't did anything with his will. Mom says it's too early & I respect her wishes. I did contact our Clerk of Courts & I was told there was no required time to do anything with his will. The problem is I have a sister. I have been told by 2 Drs that she is Bipolar & some other mental disease that I forgot what they called it. She refuses to get any treatment & thinks that she is right & the world is wrong. She is just plain evil, mean, hateful & cusses at our Mom like she is a salior, sorry to you sailors, just an expression.
When Dad died, she said he told her he wanted her son to have his S&W 357 Mag pistol. I do know for a fact from my Mom that Dad didn't leave it to him. Now her son, when he was 16-18 along with friends went to where the school buses were kept in Rockingham Co. one night. They cut up the seats, broke out all the windows, urinated & took dumps in the several buses. They also took fire extinguishers & beat the outside of the buses then emptied the extinguishers inside the buses. They were caught. I don't know what his punishment was but I do know he had to wash & clean buses for quite some time. My sister gave the pistol to her son & he went back to Greensboro Monday. I know that for a fact. I also know that I am the executor of Dad's will, Mom told me that. I was told I by a FFL dealer I was responsible for those weapons just like I was a dealer with them in my inventory. I know that before you can get a handgun in NC that you have to get a permit from the Sheriff of your county. Then the handgun is to be carried to a VA FFL holder & it is to be sent to an NC FFL holder. Then the permit from the Sheriff is to be given to the NC FFL holder, the 4473 completed & you are ran through the instant background check. The problem is the gun is gone. And I was at Mom's yesterday & I found out he has taken all of Dad's guns to Greensboro with him. My nutjob sister told him to do it. I have all of that on a digital recorder. I was covering my butt as I was told to do by our Sheriff, she had me arrested in December for assault & battery which I won in court. I had her on tape telling me to get on the stand & lie to the judge about everything. The judge wasn't happy with her. BTW, I never touched her, I also have her on the recorder saying she was mad at our Mom & took it out on me & made up everything. Anyway, I don't want BATF coming down on me about this. I told her yesterday she had 48 hrs to bring all of the guns back or I would call BATF & let her & her little _ _ _ of a son explain to them why they were carried to NC. I told her they have until 6:00 pm Saturday to have them back at Mom's house. And I was planning to go to our local racetrack & see the "Madhouse Modifieds" Saturday afternoon. She has screwed that up. So this is the tip of the iceberg of what I'm going through. I wish Dad had made a lawyer the executor instead of me. Let them deal with this nut. If I'm rambling, sorry. I didn't get any sleep last night & I'm also mad with her & worried about my Mom. She's & her no good husband who BTW has been fired from every job he has ever had for stealing are at Mom's. She came when Mom broke her hip 3 yrs ago & has been there since, she won't leave even after Mom has told her to. The last job he had was at Walmart. He was fired for stealing candy bars, batteries, movies & ink pens. He was charged with shoplifting & had to pay a huge fine. He also has a cheap Saturday night special handgun. I found out before the guns were missing that I was the executor. I found out yesterday that the deeds to all of Daddys & Mamas real estate , the titles to the 2 cars, all of their CD's, IRA's, all of their other financial papers, checks, saving account books, insurance policies, Daddys & Mamas wills & Mama's POA. It was late yesterday when I found out all this was missing. I happened to have POA's for Daddy & Mama that were done 6 months ago. When my sister found out that they were going to give me POA she had a fit & talked Daddy into not signing his & he wouldn't let Mama sign hers. So I took Mama & had her sign it revoking the prevoius POA & appointing myself POA. My nutjob sister came into the bank as we were having it done. She threw a fit showing her butt. The manager told her to leave or he was going to call the cops. He just happened to start the camera & got her threating him, Mama & myself on tape, enough if any of us decide to, to have her arrested for assult under VA law. He gave me the tape.
Then we closed out all of their presnts accounts & re-opened them in Mama's & my name. We reported to the manager what had been taken & told him if she tried to cash in or tried to withdraw anything to call the cops. He said he would be glad to! I talked to our Sheriff, not a deputy, and told him she had taken the guns to NC. He said it wasn't a criminal matter but a civil matter & I would have to get a court order to have her return them. I told him he was wrong & the correct procedure to transfer a handgun out of state. He then said I didn't know what I was talking about. Instead of telling him I thought he was a DA, I just let it go. I may need him in the future & I don't need him mad at me. I talked to the Clerk of Courts, which is an old friend I've had since highschool about her stealing this stuff. He told me I could call the cops & report it & have her arrested. I told him what the Sheriff told me. He shook his head & said that is why we need a new Sheriff. He said I could have a lawyer go to court & have him get a judge order her to produce everything that is missing, including Daddy's camera & a lot of his scrip meds that I was going to destroy, within X amount of days or she goes to jailI forgot to tell you she is on 100 whatever it is of Fentanyl patches. She has conned a local Dr that her back & legs hurts & the idiot gave them to her!!!! As for the missing firearms, she has until 6:00 pm tonight or I'm calling BATF. I hate to bring them into my life but I'm not going to club Fed because of her & her son. Today as a favor to me, my lawyer is drawing up a new will for Mama & we have to be at her office at 10:00 an to have it signed & notarized, revoking all & any previous wills. So, I hope I haven't forgotten anything I need to do to protect Mama & her assets. If I have, please tell me of anything else that I need to do. I have the banks sending me all statements to my house so nutjob can't get anything out of the mailbox. Did I forget anything? Thanks so much for all your help. This morning someone returned all the guns except a .22 pistol. They were left unattended on the carport when Mama & I were at the bank closing an account where Daddy a had given her access to. We also had her new will notarized & got my jutjob sister out as an executor. She also left, again unattended, all of the wills, CD, IRA's, deeds titles & so on. But someone went into the house & took Daddy's computer. I haven't decided what to do about that. But I'm changing the locks on the house Monday. Then I'm calling BATF on her about the missing .22 pistol.
This afternoon I thought I deserved a break from all this stupid crap. So I went to South Boston Speedway, VA to see the "Madhouse Modifieds" that "Madhouse" on the History Channel is based on. Those things are like go carts on every steroid in the world combined. I've got to go to Bowman gray to see them!!! He guys, thanks for the help! |

That sucks, I know how you feel, I was in Korea when my grandfather passed away and he had left all of his guns to me and before anybody could get them, my crackhead uncle stole and sold them. Haven't spoken to him in 19 years. You serving your country & get screwed over. Tough luck. As of mid December, I'm an only child. I know I have a lot to look foward in the future.
