I am not sure about something taking effect in HB 937 on Oct 1. Its the Educational Property section.  If you drive onto educational property does your handgun have to be in a locked container like a glovebox or console?  I ask because I have a Jeep Grand Cherokee.  Neither the console or the glove box is lockable?  So what exactly does the law say?  Does it have to be in a locked container in the car?  Or does the vehicle just have to be locked when its parked on educational property?  I'm not sure.  TIA

NC Statute G.S. 14-269.2  added section (k) effective October 1, 2013

The provisions of this section shall not apply to a person who has a concealed handgun permit that is valid under Article 54B of this Chapter, or who is exempt from obtaining a permit pursuant to that Article, who has a handgun in a closed compartment or container within the person's locked vehicle or in a locked container securely affixed to the person's vehicle. A person may unlock the vehicle to enter or exit the vehicle provided the firearm remains in the closed compartment at all times and the vehicle is locked immediately following the entrance or exit.

Remember that this DOES NOT APPLY to PRIVATE FACILITIES. Don't assume just because it's an educational facility that you can have your gun in your car.

Can you provide a statute that says a non employee can not store a handgun in a compartment in a locked vehicle on a private educational facility after October 1, 2013?

By my reading of the law:

"(1)        Educational property. - Any school building or bus, school campus, grounds, recreational area, athletic field, or other property owned, used, or operated by any board of education or school board of trustees, or directors for the administration of any school."

That means that private schools would not be covered as "educational property" But they are covered as a "school"

"(1b)      School. - A public or private school, community college, college, or university."

So because they are a "school" they would qualify as an "educational property"

I cannot see anywhere that the changes to the law remove that qualification so it appears to me that you are correct and it would apply to both public and private schools.

Thinking as a prosecutor:

SECTION 1. G.S. 14-269 is amended by adding a new subsection to read:
"(a2) This prohibition does not apply to a person who has a concealed handgun permit issued in accordance with Article 54B of this Chapter, has a concealed handgun permit considered valid under G.S. 14-415.24, or is exempt from obtaining a permit pursuant to G.S. 14-415.25, provided the weapon is a handgun, is in a closed compartment or container within the person's locked vehicle, and the vehicle is in a parking area that is owned or leased by State government. A person may unlock the vehicle to enter or exit the vehicle, provided the handgun remains in the closed compartment at all times and the vehicle is locked immediately following the entrance or exit."

I think that we will discover very few parking areas in private colleges fit that description and if there are any they will not be designated as such. This (I think) is how Duke and probably several others will be able to ban on their campuses.

14-269 deals with concealed weapons... adding (a2) applies to that.

14-269.2 deals with concealed weapons on a campus, section (k) is added for that purpose.
