I THINK what sniper was getting at was LE are not legally required to act when ur in need. You can't hold him accountable for not acting when he/she could.
That being said all the LE I know and have met are good people who are out there doing their best. I would never want to give them up any day. |

EDIT: TheMirage got it right. What I was going for is they have not legal requirement to protect us, as I show below. Also as I state below I have absolutely no problem with individual police officers and have a great amount of respect for them. It is just another case of peon vs boss. While the individual cops may be awesome the group they work for sucks. Another thing to think about is that individual cops are (generally) not politically driven while departments usually have appointed positions and bull shit bureaucrats running the show along with management. (I could write a book on how and why management is an absolute waste of money and impairs work forces). As always if you have a problem with something that I have said make sure that you understand where I am coming from and I am more than willing to have a civilized conversation and a good debate about almost anything! I have no doubt that many would give their lives to protect someone but that is not their job. The only role of any law enforcement service is just that, law enforcement. They are not there to protect people only to seek out and arrest those who are breaking the law, any protection afforded by that is a result of enforcing the law. While this view probably wont be in favor with a lot of you, I will have to say tough shit as this is how it is. "Warren v. District of Columbia Metropolitan Police Department, 444 A.2d 1 (D.C. App. 1981), the court stated: `… courts have without exception concluded that when a municipality or other governmental entity undertakes to furnish police services, it assumes a duty only to the public at large and not to individual members of the community." I have no problem with individual police but the unfortunate fact is that all law enforcement agencies in existence are shifting to a more proactive role. While one would think that this would be a good thing, and it would be if their job was to ensure safety as a primary goal, they do this by placing undue focus on everyone they can. Law enforcement agencies need to move back to a reactive role and allow the people involved in the individual situations to deal with them on their own. The aggressive and proactive roles that are being taken seem to be more about scaring the public in to doing something a certain way and oppressing them. Case and point, seat belt laws. If someone were to get into an accident and become severely injured while not having insurance, the municipality (the taxpayers) would foot the bill instead of the person who was injured. This is was lead to the seat belt laws. It was cities covering their asses. Now we have massive advertisement campaigns threatening to ticket or arrest individuals who do not follow them. While an after affect of these laws were a decrease in deaths that was not the cause of them being enacted, and the enforcement is simply another way for the city to make money. |

As far as proactive vs reactive, isn't an ounce of precention worth a pound of cure? Would you rather that your local law enforcement simply come and make a report after your house is burglarized by crackheads, or would you rather they take and active role in patroling your neighborhood to stamp out burglaries and the underlying drug problem to prevent your home from being broken into in the first place? As for the DMPD Officer, I know this kid and would have absolutely no problem working with him. The way I understand the story, thank God he missed the guy, but nothing the Officer did was wrong....so why would he face disciplinary action? As for all of you who seemed to jump right on the armchair quarterback wagon....well, I would like you to take a few seconds and think about that while you are out at the range. You know, shooting at paper targets that do not shoot back, without thoughts that you may be walking into an active shooter situaton (like he did), your heart pounding in your chest at what you are walking into. | Here is my two cents worth, As LEO's we take a oath to serve and protect the public as well as enforce all laws, plain and simple, second, for those who have never done the job, but are able to offer their opinions on how they would have reacted, or how bad the cop reacted, or how they could have done a better job, why don't you get a job as a LEO, go to the academy, get on the street, I am sure in no time at all, crime will decrease, evil will be off our streets, and you can proudly wear your cape as the ultimate crime fighter. |

Does the oath that you take come up as a deciding factor in the decisions that each and every single one of your superiors make? I saw the exact same crap happen in my rotc detachment with some of the officers. colt did you even read my post? did I say he did a bad job? no! did I say how I would have done it? no! Let me get this straight, police are responding to an active shooter/shots fired call. They are told the shooter is still there and given a description. First officer on scene observes an individual matching the description. The individual has something in his hand that appears to be a gun and then the individual makes a movement that the officer felt was threatening. Officer fires at individual, but misses. Did I miss or get anything wrong?
Now the great discussion: If the officer would have hit the person he would have been wrong, vilified and his actions scrutinized by everyone.. Because the officer missed the person he is wrong, vilified and his actions scrutinized by everyone. Glad I'm retired.

| My whole problem with the story is this. I have never seen a cell phone yet that looked like a gun. What make and model is that? Now yes the situation was rife with stress but whether a cop or a civilian you have a responsibility to be sure of the situation before pulling the trigger. I know a few cops,in fact live near one, and some are great and some have a lot to learn mentally. |
| What planet are you from, you talk about being a educated college student, a ROTC, but you don't have a clue as to what a LEO goes through after a shooting, let me give you some information, after the shooting, the LEO is relieved of his weapon, as evidence, he is interviewed by Detectives or Internal Affairs Investigators, he is usually put on paid adminstrative leave, until the investigation has been completed or it has gone before the grand jury, which sometimes takes weeks or months, pending on how the investigation comes out, either ruled as a good or bad shooting, the LEO is subject to investigation by the Federal Justice Department, as the victims family will file a violation of civil rights suit, you also have to remember that the family has the right to sue the LEO in state civil court, the LEO will usually have his own attorney, which will cost him enough that he will have to put his house up for sale or get a second mortgage, the LEO will possibly have PTS, and will have to see the head doctors before being released to come back to duty. There are studies that have been done, that alot of LEO's marriages suffer after a shooting where a life is taken, which is from the stress from the media, public out cry, and all the other bullshit that goes with it. Oh, there is one more factor, some LEO's can't handle the stress, and have suffered mental problems as well as suicide. After I have read the article I still hate reporters as they are of bunch of liberal rat ass kissing bastards. I am glad the cop missed only because he (the cop) may have suffered psychological damage, criminal charges, civil action or been fired. If the ignorant reporter did not want to get shot at he should not have his dumb ass in a dark area. |

[/div] We agree on this, to enforce the laws on the books, no less. (and to do so while being fair and impartial)...as far as more, I guess the way I was raised with a good work ethic is a bad thing? As for catching a bad guy before he targets you...well, most bad guys do a lot of things wrong, and if I catch him in one of them (burglary, dope, whatever...)then he is not going to hurt you or your family (or me or my family for that matter) for however long the courts deem him to be away from society. A sticky situation, kind of an understatement.......anyway..... Someone made the comment about never seeing a cell phone that looked like a gun.....wow, try this under stress in the dark believing that people are getting hurt and that YOU may be able to stop it, then seeing someone pointing an object at you. Yes, thank God the reporter did not get hit (something else I think we can agree on). As for the 1-2 second draw?????? Try .25 seconds, (please remember, we have to "react" to situations.... and reaction is ALWAYS slower than action) that is the usual time to observe a situation formulate a response (from the mental list of all possible responses) and act, then add about the same amount of time to draw and engage. I can go into detail if you like about the physiological aspects of Force Science (the study of how the human body and mind react in use of force incidents) but it will derail the topic at hand (PM if you want to know). We can also agree that YOU should take your personal safety seriously. (as should everyone, kind of a responsibility that goes along with rights in my opinion)....the cops can not be everywhere at once, and ultimately YOU are responsible for YOUR own safety (see my post last month about responsibility and rights). Should you feel uneasy that this officer did not hit a target on command at 16 yards? Well, kind of goes back to 1) training vs experience and 2) cops are people too, we are not created in a lab somewhere, it takes years to learn to deal with things that happen on the job, you don't just walk out of the academy with the ability to solve the worlds problems with one hand tied off. In my almost 18 years on the job I still learn things.....some situations can be "like" others but ultimately no two calls are exactly alike and just about the only way to deal with things is by time on the job and learning as you go (ie; experience gained). Just my opinion on this and the other coppers can jump in if they like, but when something like this happens it simply amazes me how fast people jump on the bandwagon about how "they would have taken care of the situation differently"(from the safety of their own home...and with all the time in the world to think about it), or how other people seem to remember the cop who gave them a ticket (that they probably earned ) and this is their chance to gripe about that guy....you know the guy that would step into danger to safe your life. I think the bottom line is this, there are little intacate details of everyone's jobs that no one can understand unless you have done that job. A good friend of mine's father is a carpenter....I can frame, and do some of the work myself, but when I have him around to help me he seems to know the answers to questions about carpentry that I haven't even thought up the questions to yet. If this isn't a hometown issue, then what is? my response was more or less directed at Bionic... i enjoy a good intelligent discussion in hometown and this very well could of been, but as soon as it became a "Cops suck" type thread i lost interest... Now voicing an opinion and backing it up with some actual facts is fine, but a lot of the time people like to sneak in cheap shots against police. This is why I keep to myself most of the time, I do a lot of lurking on here. I will type something out meaning it one way, but the reader can interpret it in a different way. Then im forced to explain, and by that point people have already stopped reading, and started being pissy. But on the other hand, i do often get tired of the attitude that a lot of the LE's display in these types of arguments over in GD... I had a two hour discussion last night at work with a friend that is working on his criminal justice degree (his dad was on the force for 15+, and i also have an uncle who was on DMPD for 20+, so we both have a lot of respect for LE), during that discussion my argument was very similar to what Bionic was trying to get across, but i feel like i did a better job getting it across without sounding like a cop basher. P.S. my train of thought got lost somewhere when i was writing this... i really need to get off the overnights, its messing with my brain. |
| I am a RN now. I was in the national guard for 14 years as infantry, antiarmor, scout and food service in LeMars, Iowa. That being said I would have loved to have been a cop except the pay sucks and you get to deal with all the trash and you get lawsuits filed on your for doing your job so I am staying with being a nurse. Less outside in the shitty weather work this way. |

Your points are well taken. As a retired US Army Officer, I know better than many that commissions are earned, not given out like college degrees. In this day and age of Internet forums and social media, everything we say and do is "out there" forever. If my comments seemed overly strong, they were not meant to be construed as a threat, but at the same time, I would like Bionic to take into consideration that what he posts here could have an adverse effect on his long term life prospects. I know several professional pilots and a few law school graduates who are not working in their chosen careers because of single mistake or errant comment or improper act caught on camera. I know better than many about the sureties of youth and talking when I should be listening. If I offended Bionic, he has my apologies. All of us in the public realm, be it law enforcement, politics or the personal services business need to be sensitive to how we treat others or the comments we post on web boards. You never know when it could come back to bite us... |

Well I must apologize to many of you. I did not mean for this to come across as cop bashing. I've been rather busy with school so I've had no time to hop on here. As I am sure you can understand what I have said are from the views that I have gained thus far and having never been a LEO there is a perspective that I am missing. Also as I previously stated I would love to sit down with some of you and have a meaningful conversation. If I have soured anyone's view of me I accept that but hope that those of you who know me allow me to make it up to you. |

in point of fact while they don't make it known to the public but MANY of the KCCI staff are not only progun, but carry. they're neither dems nor libs. some are instructors, and a one owns a training business... while it is too often true the lib agenda is ripe among the media, this was a camera man and a generally good guy. while i have the urge to jump on that bandwagon myself, you aren't in the know about this particular scenario, place of business, or personnel...
