For shotguns and long rifles, why does no one actually do it?

1) The practical applications for this are actually pretty slim, in my opinion
2) They can find other reasons to take you to jail if you do this.  You may (or may NOT) beat the wrap with $$$ and a good lawyer, but you ain't beating the ride.  I've spent a night in the county lockup due to someone else's screwup before, and that fact that it wasn't my fault was VERY little consolation (the settlement check, well, THAT helped!)




Basically, when is it really worth the risk?

Reality is, you probably better carry a good explanation with you as well.  If you want to just sling your AR down main street, you are probably going to get some unwanted attention.

Not really a law saying you can.  Just no law that says you can't.  There are a few places you can't carry.






Sec. 46.03. PLACES WEAPONS PROHIBITED.









Most of the time they'll point to this law if there's trouble:







Sec. 42.01. DISORDERLY CONDUCT. (a) A person commits an offense if he intentionally or knowingly:


(8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm;

Do a google search plenty of video of open Carry of longarms in Texas. :-)



I myself am not interested in carrying an 8lb rifle when it is 105 out like today. YMMV.

I've given this some thought, cause I love my AR, and we hate to be apart. However,

1) Its not generally considered polite to carry a rifle around when a) none else is carrying one and b) you have no reason do to so other than to draw attention.
2) In most circles, some random bystander WILL become very alarmed and call 911.  
3) The cops won't assume you're harmless
4) They might pull a gun on _you_
5) jail and disorderly conduct charges if not worse.
6) and few juries will by sympathetic.

Clearly having the right to do something doesn't mean something is a good idea in all situations.   Its possible, and in some situations you can get away with it (didn't a guy bring an assault rifle to a political rally a while back?)  

But until we're all on high-alert for some plausible threat or strife, and outside the usual venues of gun commerce, ranges, hunting applications, or realistic possibility of self-defense, its generally not really the polite or safe thing to do.  

Sort of like carrying around a vat of acid everywhere you go, statistically its going to result in a few melted body parts now and then.

I don't lug a rifle around on foot (usually) but when I do, it is slung on my back. Its not that people don't OC rifles, its that they don't carry them around period unless there is a need.

Now storing in a vehicle I keep covered to avoid theft.

17 years ago, we'd shoot rifle matches in the high school basement.  You really needed the eye protection down there!

There was talk in the past of organizing roadside cleanups with everyone open carrying a long gun.  I don't think it ever happened though.

The problem with (8) is the definitiion of "manner calculared to cause alarm" part...  Now sensible people would interpret that the way the writers probably intended...  to mean "So don't go pointing it at people or being threatening".  Now sissy mamby pamby libtards these days are alarmed just SEEING a firearm.  Oh!  They are SCARY!  Especially if they are one of those EVIL black rifles.  You know an "ASSAULT WEAPON".

If it were up to me, I don't think an LEO should have any right to question anyone in Texas who were to choose to walk around with an AR slung over their shoulder...  But it isn't up to me, and chances are you'd not only be questioned, you'd probably be lucky if you didn't end up in jail and facing disorderly or whatever else they decided they could get away with trumping up on you.

I do it all the time on my motorcycle on my way to work (gun club), right through the middle of a busy city. College town, nonetheless. The police just turn their heads as I go past, but that's all they have ever done.

95% of the people honestly don't even notice.

ETA: 20" lightweight flattop w/ACS and an M68/LaRue combo, TRX extreme and DD backups. MS2/RSA/ASAP keep it tethered.

Is that legal? I've been gearing up (mentally anyway since I'm broke) to build an SBR (AR) and possibly carry it in my laptop bag.

Actually, pointing a gun a person is DEADLY CONDUCT, which is even worse. An example of carrying in a manner to cause alarm, would be carrying as you walk by your neighbors house, whom you have had arguments with in the past and want to intimidate with the gun.

Open carry is a bad idea in this day and age, heck I think too many people do it just to see if cops will harass them. I am all for concealed carry though.
