open carry reply from SFLU I remember someone once asked about open carry in CT here is a reply from the CT SFLU about it. Interesting read. |

We continue to act on the revocation of a pistol permit on a case by case basis." Send him a letter explaining you are uncomfortable around black people and you would like them all cited for disorderly conduct. After all according to his other letter , all that is reqired is that you be alarmed. |

is there any case-law in CT on this? i know that in many states where open carry is legal, but there are urban centers that are... not pro-gun... there is case law addressing these issues. it has been decided, nearly universally in open carry states, that an openly carried firearm is not, in and of itself, enough to constitute "disturbing of the peace" or any other such nonsense, regardless of how "offended" or "uncomfortable" someone happens to be at the sight. ETA: i'd also like to see how they square-up their "opinion" with the hunting community in CT. during hunting season people walk around with openly-carried firearms all the time. are they asserting that this activity may be illegal since CT is "not an open carry state"? ETA2: nevermind. i read through that link and, as i thought, it appears to me that someone just being "offended or annoyed" would not constitute a breach of peac on your part unless you were waving a gun around or something. someone will have to take the state to court though... |
Ed Peruta has filed a lawsuit seeking a declaratory ruling and $15,000 challenging it. That case will give us the important answer. |

The DPS in this state does not seem to understand that their opinion does not matter. They are a LAW ENFORCEMNT body not a LAW MAKING body. Until this little issue gets cleared up we, unfortunately, have to deal with BS such as the "AK Type" ban and the like. Once again the guy who lost his pistol permit because of that incident at Chilli's, was cleared of all charges. He then was issued a new town permit and the CSP would not issue him a new state permit. What is wrong with this picture? |

Yeah basically if their language breaches your peace then yes they can be arrested. |

Unfortunately until someone challenges this openly with a lot of backing and publicity, it won't go nowhere. By definition , anyone with a disease, cold, aids, cancer, etc..etc.. could be arrested because they could cause a disturbance with sheeple. Thank god we're that BAD .... yet.... Heck smokers are getting there soon. |

Its not that people are “inconvenienced” by people open carrying, it’s that they call 911 who dispatches the police to a “man with a gun” call. The police then show up show up (as in James Goldberg’s case) and arrest the OC’er for “breach of peace” or some other non-gun related violation. Until there is actual case law or state statues on the books that specifically ALLOWS open carry, anyone who does so runs the risk of being arrested by an overzealous police officer who thinks OC is illegal (as the State Police apparently think it is). Our problem is once arrested, we loose our permit and it will take years, and a lot of money, to get it back (if ever). On a side note, fortunately this state isn’t as bad as MA, NY and the Jersey (where you need a permit to buy a BB gun hen) down in Washington DC earlier this year. But I digress. |
