Can you get in trouble for open container if it's in the trunk, outside of the passenger compartment of a sedan?
Container in question would be a half-empty bottle of liquor, capped of course.

Is the back, back part of an SUV or a hatchback considered part of the passenger compartment?

I have heard of someone getting cited for beer cars in bed of truck, but never heard anything to confirm/deny its true.  If they cite me for those cans I pickup out of parking lots, crush and throw in the bed Im taking thost to court,

if the bottle is not within reach, then you shouldnt have a problem. unless the glass in the console is full

$125 a pop. But it was easy to tell these hadn't been picked up on the side of the road, but rather, had recently been 'used'.

"Passenger area" means the area designed to seat the driver and passengers while a motor vehicle is in operation and any area that is readily accessible to the driver or passenger while in his or her seating position; provided, however, that such term does not include any locked glove compartment or, in a passenger car not equipped with a trunk, any area behind the rearmost upright seat or not normally occupied by the driver or passengers.
