I just purchased a CPO Sig 226 that one of the dealers here is offering and I have a question concerning magazine capacity. Since the pistol was manufactured in 1991 is it OK if I use the 15 round mags that are available, or am I forced to comply with the current 10 round maximum? Thanks guys, Tony |

Because glock 33 round mags are scary looking no doubt, even though they're not legal anyway since they have 33 rounds. ETA what's the legality of loading a highcap pistol magazine into your pistol caliber carbine that takes pistol mags? NYC says you can't have a rifle mag that takes more than 5 rounds... |
You would likely be arrested and imprisoned for even thinking about doing something like that.

Rkbar...wasn't there something recent where P.C. Kelly sent letters to all pistol holders saying that pistol permit holders could not possess magazines in excess of 10 rounds regardless of date of manufacture? |
If he did, I didn't get it, and PC Kelly didn't get back my lawsuit either. |
Its certainly possible that the letter was never sent, I just remember a thread posted on here months back that stated that Kelly sent a letter to all NYC pistol holders that basically stated that if you had any "hi-cap" magazines listed on your pistol purchase order when you obtained your permit, you would be required to show that they had either been disposed of to an FFL or a police facility or else your permit would not be renewed (of course I am very much aware that just because there was on ARFCOM thread on the subject doesn't mean it actually happened).. I certainly hope its bogus |
It was strictly concerning NYC Pistol Permits, not NYS....and I"m not even sure it it actually happened |

Again, I never received one, so I'm considering it bogus. ETA: I know it's bogus. The following statement from the linked thread is untrue: "Criminal penalties for possession of high-capacity ammunition feeding devices, by pistol license holders and retired NYPD MOS have been put into place. Regardless of when manufactured, or how marked, or when imported into NYC or NYS, they are now contraband, and are not “grandfathered”. " |

Just playing devil's advocate here...as the pistol licensing authority in NYC...can he make some type of statement that NYC pistol permits are invalid if a pistol has more than x amount of rounds? This is just hypothetical now, I'm going with that supposed letter being bogus for now. |

RK could pass an administrative condition to your permit that you agree to have no more than 10 round magazine. NYS courts have generally been very receptive to the ability of the licensing officer to impose any restrictions that he or she sees fit to attach to a permit. However, given the existing Ad Code deals with this topic explicitly in allowing 17 round mags, you would at least have an argument that such a restriction is inconsistent with the legislative intent. In any event, there is no way that RK could attach any sort of criminal sanction to such a rule. And yes, Sharky30, that was sarcasm . . . |
