I have a question regarding the handling of pistols in NY.

Lets take this scenario:

I am over 21.  I go to the range with a buddy.  He has a pistol permit, I do not.  Can I, under his direct supervision, shoot his pistol, or must I have a pistol permit to even handle and shoot his pistol?

To my understanding, I am not allowed to shoot it.  Furthermore, if I do have a permit, I am not allowed to shoot a pistol that is not listed on my permit.  

Is this really the case?  If so, isn't it a little rediculous that a 14-20 year old, who cannot have a pistol permit, can shoot the pistol of someone with a pistol permit if under their direct supervision, but not anyone over 20?

I tried to answer all of these questions myself by reading the Nassau County Pistol Permit handbook, but it's about as useful as tits on a bull.

How I understand it you must have a permit to even touch his pistol which is the stupidest thing I've ever heard (actually the hicap mag ban in NY is the stupidest). I think it's that if your under 21 you cannot handle a pistol but either way 20 or 21, if you were at a 24hr range on the eve of your birthday and were shooting at 11:59pm it's legal but as soon as it hits 12:00am your a criminal. NYS gun laws are pathetic.

Actually NY law is weirder than that. UNDER 21, they can "practice" or "compete" from 14-21, but not above 21. Here are a few links to read, interesting.

ive seen numbers of LEOs bring random people out shooting, many without permits.

No gestapo is going to pop out the bushes and book you for letting someone use your pistol at a range.  

Yes its in the law that you cannot do this,...its one of those laws that they DONT ENFORCE.

and again, I know many here will freak out when I say go ahead and do some target practice with him...cause its illegal.

Im not saying do somethin, illegal, I am just saying...its not something thats enforced, or that you have to worry about.

If you are 21 you are expected to have your own pistol license. There is a provision in the licensing law to allow someone 21 or over to fire a pistol at a range with an instructor if they have applied for a pistol license and have also received permission to do so from the pistol licensing agency.

The licensing law was changed years ago to allow a licensee to shoot a pistol belonging to another licensee at a range. The other licensee must be present at the range so you still can't lend a handgun to someone else.

The law was changed twice to allow "youths" who are ineligible to get a license to shoot a handgun in NYS.  It still sucks but it is a step-up from the original licensing law.

Semi-related question: Is it legal for me to allow a prohibited person (drug addict, felon etc) to handle or use my rifle while at a range under my direct supervision?

Not asking if it's smart, just if it's legal. hinking.gif

NOPE

felons cant even have ACCESS to firearms.  So if your married to a felon, and you have a gun in the bedroom up against the wall with easy access, thats illegal.  Must be locked up and not accessible to them.

Felons cannot touch, possess, shoot, etc ANY firearms.
