Sorry if this isn't interesting, I just need to vent. This morning I was at mitchell field with my bolt .22 and my Ak (with 2 pre-ban 30rd AK mags) minding my own business. I was (of course) conducting myself in a safe manner using carefully aimed fire etc. Out of nowhere, some fudd cop shooting his pistol in the bay next to me approaches me while I was doing a reload on my AK. He starts off right away with 'I'm a cop and that Sh** you have there is illegal and you should be arrested'. I was like, WTF, this is a legal 30rd pre-ban mag. Guy knew nothing about pre-ban exceptions and insisted that what I had was illegal. After feebly defending myself for a minute, the guy in the next bay with his ar15 (also with a pre-ban 30rd mag) comes over and jumps in on my side. The situation ended with me casing my AK and just switching to my .22 and the guy blowing a whole lot of smoke around. I've gotta say, this has really left a sour taste in my mouth. Whether or not the guy was a real cop or not I'm pretty discouraged. How the hell do I prove these mags are pre-ban? A good friend of mine is a NYPD PO and he basically tells me most of the guys he works with have no idea about the relevant law. I know some of you have suggested carrying a copy of the relevant section of the AWB with you, but what do I do about proving these are pre-ban? I feel like the situation could easily have escalated with me being arrested by an eager beaver who wanted to get a collar. It also doesn't help that I look young and therefore I obviously can't know anything about the law. P.S. If that guy who came to my aid was one of you, thanks. |
| Carrying a copy of the penal code would help, and as far as I'm concerned the burden of proof is on them, not you. I remember in the case of the kids running down the block with the AK (somplace near syracuse, don't remember) they couldn't charge him with a violation on the mags because they coudn't tell when they were made. |

Wow, that sucks. I know the burden of proof is on the state, but I'd hate for it to even get that far Would carrying a printout of the section that states preban mags are OK really be any good? I mean, if it's just a printout that someone printed on their own computer, who's to say (as far as LEO are concerned) that you didn't just type up whatever wanted, and printed it? ![]() Not that the cop probably cared, but at least someone was there to back you up. |
| Ask for ID, if he refuses, call 911 and say there is a guy impersonating a PO. I know that I have to ID myself when asked. Tell him to arrest you, if he doesn't then he is derelict in his responsibility, If he does arrest you, or detain you for less than a resonable, call your lwyer on the cell, tellhim the department and name of the guy, if you know them and tell him you want to file a wrongfull arerest and sue him under tittle 1983, .....oh ask if he has a house and other tangible property that you would like to own. |

After I receive my next order, I'll have 96 preban mags. I've told myself that from now on, I'm only leaving the house with dated mags. Should I have to do that? No. I'm going to do it anyway. Should you guys do that? I dunno. Sometimes being right just isn't enough....especially when the guys with the handcuffs are involved. |

+1 to what the wind said...People like the guy that was harrassing the OP need to get verbally beaten back into their place and then ridiculed. I can understand where the OP is coming from that he didn't want it to escalate, but at the same time you can't let some idiot that has no idea about what he's talking about yell at you and make you look/feel like a criminal when you're the one that knows what your talking about and doing and he's just some dickhead that thinks he's above you. From the sound of the way the guy approached you he probably wasn't even a cop. At a minimum I woulda found out who it was and let the range and if he had a department school him on the laws and let him know that you felt harrassed by someone about something they apparently have a lot to learn about. There are so many pricks in this hobby/industry it's not even funny. There's a lot of good people too, but it seems like either or are at full oppositte ends of the spectrum. |

I would have immediately asked for ID, which he should be showing as soon as he says he's a cop, and if I am commiting a crime, why is he walking up to me and telling me "oh that's illegal", arrest me on the spot with a weapon drawn since I clearly am armed. Otherwise, I would have called 911 on my cell and reported a man with a gun claiming to be a cop and not showing his ID. Also I stay the hell away from mitchell field. |
| Most LEO's DO NOT regularly enforce the section 265 laws, actually few Investigators run into these things. That is why the NYSP formed the GIU and even within GIU there are only a few who can make a decision on the law from their head. Telling him to fuck off would not have gone well BTW, there are about 5000 laws in NYS. |

I would have placed all item on the bench rest and asked for ID - If he shows me a badge I again ask for ID not a badge ( igot one of those too big deal you can buy them for 20 bucks in Galls) - If he shows me a department issued ID I have the right to remain silent - If the shit was illegal (which it is not) he has a duty to act. That would be like seeing a drug deal, rape, murder etc... and saying "hey man that's illegal" and not doing anything. Fuck him, he's probably not LEO he's probably FOS. He can have a plate of Eat Shit and wash it down with a nice big glass of Shut The Fuck Up. |

I'm actually thinking of simply shipping my guns to myself at my destination any time I have to fly with anything more than a shotgun or a pistol. The funny thing is, the whole time this was going on, the TSA guy and I were shooting the shit about ARs, optics, etc. |

Im a cop....You should of just ignored him and just kept shooting your AK. I shoot my AK & AR all the time at Mitchell Field. Most cops I know would not get involved with this silly stuff off duty. Good chance he was not even a cop. Give me a shout next time your going to Mitchell Field....Would love to shoot with a fellow AR15.COM member. John |

Given the fact that since October 2004 most manufacturers have gone back to making non dated magazines, a punch set isn't a bad idea. I know the law says THEY have to prove it's post ban, but I know I don't have dated receipts for every high cap I own. |

Ok, so this brings up an interesting issue: lets say I get a punch set and date these suckers with a date before the ban date. Is this legal to do? If it ever becomes an issue, could someone go down for some sort of illegal misrepresentation of a firearm component (ie. similar to defacing a serial number)? Really, I'm not attempting to misrepresent an illegal component as legal, just reaffirm the legality of the item with a blatant visual indicator, albeit one added myself. |

Not an excuse but in the city any EBR with even one "Evil" feature is not legal so training about them is pretty much nill (Might be different now but I doubt it.) Most of the guys I knew when I was on Patrol weren't even interested in Firearms so would love to bag a guy with a "Machine Gun/Assault Rifle." Dated mags wont help you if you incounter one of these guys unless when you get brought down to the house they actually look further in the Penal Law when looking for the info on the "Crime." I even carry the AWB Exception part of the PL with me laminated and everything. That will at the least make the guy think twice or call a Boss before making the Collar. In the OP's situation I would have just told him he was wrong and then informed him of the law. If he pushed it I would ask to see ID and if he displayed it just leave it alone. As was said in a post above there are thousands of laws and even if your right getting arrested is a PITA. |

When I had my argument with them about my not having to tell them why I was flying with an AR15 they told me they were calling an FBI agent to "come seize my guns" when I laughed at that they did try to call about my pistol permit, but it was after hours so no one answered (I could hear them making that call). They never did follow through with their threats to try to have my pistol permit revoked; however I would not start asking for badge numbers there if I was not willing to have them file some bs complaint with the issuing judge. I wouldn't tell some random Officer Sarah Brady guy to fuck off. We saw the kid arrested by the Monroe County Sheriffs for no reason because the responding officer assumed his post ban ar and ak were illegal. Better to join a club, there you usually know the members and whether there are any anti cops in the club. edit the dopiest part of the nonsense with the Syracuse PD was after saying that I had to answer their questions because "I could be going to Virginia to kill someone" they left me with an AR15 and a pistol unsecured inside their police station, they left me alone and they had no idea if I had magazines on me for the firearms. Of course they never really thought I was up to anything, it was just "Respect my Authority" silliness; however if I was going to do it over I'd have given a less confrontational answer since the hassle of getting a "Pistol Permit holder Aimless told Officer Gungrabber to go fuck himself" or some other phoney baloney complaint sent to the judge would have been time consuming |

Both times I've flown out of SYR with ARs, I've gotten compliments on my guns and chatted with them while we were waiting for the police. This last time the guy seemed to really be into EBRs. As for the cops, the first time, the cop took out my Glock and XD, knew right where to look for the serial numbers, checked them against my permit, smiled, handed my permit back to me and said "have a nice day." This guy this last time was a moron. He kept looking at the slide on my Glock, so eventually I said, "Sir, the serial number is on the bottom of the frame, in front of the trigger guard." He asked me where I was going and what I was doing, and I told him.
