I was talking with my church preacher and the topic of guns came up.  He was saying in theory if he saw me carrying in church that he would call police and have to have me arrested.  When I took my CCW class we were told that if you did in fact violate the no carry in a place that you would be asked to leave, if you did not leave you would then the police would be notified and they would remove the weapon, escort you off of the property, return your weapon, and then write a ticket that included a $100 fine.  I was told that you are allowed 3 then they revoke the CCW for some time......I don't remember but I want to say 3 years.  Does that sound right or being it is a church is there a mandatory arrest?  I just wanted to make sure of the law.  Thanks in advance.

BTW this is a church in Saint Charles County, unincorporated.

thats pretty close to how I remember it....contact your class instructor and ask for clarification about it being in a church and I'm sure he'll let you know.

I dont bring it up if I think it might be questionable...I just carry and go on. If people start flopping ignorant opinions around I do step in with a dose of reality tho.

Pursuant to RSMO Section 571.030, if:
1. A person commits the crime of unlawful use of weapons if he or she knowingly:

...

(8) Carries a firearm or any other weapon readily capable of lethal use into any church or place where people have assembled for worship, or into any election precinct on any election day, or into any building owned or occupied by any agency of the federal government, state government, or political subdivision thereof; or

...

7. Unlawful use of weapons is a class D felony unless committed pursuant to subdivision (6), (7), or (8) of subsection 1 of this section, in which cases it is a class B misdemeanor, or subdivision (5) or (10) of subsection 1 of this section, in which case it is a class A misdemeanor if the firearm is unloaded and a class D felony if the firearm is loaded, or subdivision (9) of subsection 1 of this section, in which case it is a class B felony, except that if the violation of subdivision (9) of subsection 1 of this section results in injury or death to another person, it is a class A felony.


So, long story short, it is a criminal act to carry into your church per Missouri Law.  Having said that, this is not a mandatory arrest for it is at the discretion of the responding officer(s) whether or not you will be arrested or cited for the offense.

EDIT:  Class B Misdemeanor carries with it a possible imprisonment of up to six months and/or a fine up to $500.

I say if your preacher is going to deny you the right to defend yourself in "his"church I would go somewhere else...Further more i wouldn't ask..I would just do it...Im sure he believes that an angel will come down and stop the bad man from hurting anybody... . You might direct the question to the decons who generally are more in charge than the preacher that has been hired to do a job..

Actually he can as you to leave, if you refuse, he can have you removed, thats it, if he dosen't ask you to leave before he calls the police, then they can't even fine you. Same goes for a sign, if no sign, you haven't broken any laws by carrying. If the sign is smaller then 11x14 or the letters are smaller than 1inch, sign dosen't count. Thats the law. And for a 1st offence, its $25. Thats it.

Not surprised though, most people who don't shoot or know guns, think that gun laws are much stricter then they are.

If you're going to carry a firearm concealed, knowing the statute is pretty much the first thing you should master.  If you don't know, don't carry.

Right here is where you failed.  Concealed means that nobody but you has to know.  I carry everywhere, except on the rare occasion when I have a drink.

It flat-out isn't any of his, or anyone else, business.

is this preacher aware of bad things happening in churches also? I know of an old man, must be about 70 yrs old who is the greeter at his church. And his church is thrilled that he has a ccw.

I could not continue to attend a church where the preacher is such a fool about the ownership and proper use of a weapon. All evil needs is for good people to do nothing.

Our church in O'Fallon had a deranged man barge in during the service one morning.  No one knew him or had ever seen him.  The ushers pulled him out and nothing bad happened that time.

Opposition to concealed carry in church is simply foolish, weak minded thinking.  Or to open carry, for that matter; part of your Sunday Go To Meeting attire should be a nice HiPower in a belt slide holster.

Carrying of a concealed firearm in a location specified in subdivisions (1) to (17) of subsection 1 of this section by any individual who holds a** concealed carry endorsement issued pursuant to sections 571.101 to 571.121 shall not be a criminal act but may subject the person to denial to the premises or removal from the premises.



Not a criminal act.  Not saying you can't be arrested, but you can't be charged with a crime.  You can be arrested at any time for any (made up) reason, with no repercussions for the arresting officer.
