Im from Indiana and I  have a pistol I want to give to my father in law for christmas, who happens to live in Illinois. It will be a gift, so do I still need to do a transfer through an ffl or can I just give it to him? Btw, he is an LEO. Not sure if that make a difference. Thanks for your help.

A licensed transfer in Illinois is required and he needs to possess a valid FOID.

If he comes to Indiana to get the gun then abide by IN laws. Gifts from family members do not require an FFL transfer. That is what my IL FFL holder told me when I ran into a similar situation

He will be in Indiana when I give him the pistol. So do we follow Indiana laws or Illinois laws? What will he have to do when he gets back to Illinois? He does have a FOID card and is a full time LEO.

Agreed.  Find a FFL to do the transfer.  Might seem like a waste of money but better safe than sorry.  Handgun across state lines is a no no.  Folks might argue about it being a gift  but why take the chances.  If he doesn't have a FOID tell him to get one so he doesn't get into trouble.

It looks like the FFL transfer is the way to go. Do we do the transfer here in Indiana or in Illinois?

Use a  licensed seller in Illinois, and the deal is done in Illinois. Where does he reside[your in-law]?

Gift or no gift does not matter.  No interstate pistol transfers without an FFL.  Doesn't matter if it's face to face.  Spend the $20 at an FFL or risk spending time in jail and losing your guns.

My dad lives in Indiana and when he comes over to shoot, he leaves them here for me to clean until he comes back over. I've always wondered if this is "legal"
How would they prove whats mine and whats his? Some of his guns were bought at a hardware store back in the late 50's early 60's.

Good point. The pistol will never be shot. We are going to mount it in a shadow box for display.
