I was just reading the Florida CLEO thread and am a little confused being new to the state.  It looks like nobody has replied in months to that thread so I'm posting here.  So can i use a trust to get around having a sheriff that won't sign off on a form 4?  I see posts in that thread talking about an executive order the doesn't allow this going into effect Jan 1 2014 but no links so really confused.

For right now, yes, a trust can be used. ATF is still mulling over comments to the CLEO requirement.

is there a proposed change in federal or state laws on this?

its under review and hopefuly wont go anywhere but you at least until the end of the year before any changes are made. Go ahead and get a trust setup and start filing now though. That way if something changes later you still have at least some stuff already

This is Federal, not state. The proposed rule you're looking for is ATF 41P:

thanks.  looks like if u already have items on a trust and a tax stamp those items will be gtg.  Im going to call the Volusia Sherrifs office to see if he will sign off…if not, ill go the trust route.

I don't think Sheriff Ben Johnson signs NFA, but it can't hurt to ask. Also ask the police chief of your city, head of state police, state or local district attorney or prosecutor.

I prefer the trust route, however. It might seem like a lot of up-front work, but the work to set up a trust pales in comparison to the work required to get a CLEO signature.

very true.  i was recommended to Joyce who is a non lawyer document preparation service by the florida gun exchange.  they said she has been doing NFA trusts for the area for over a decade and highly recommended.

Short story: Ignore the implications of 41p (for now). Get trust. Start sending Form 1s and 4s as your desire and income allow.

The proposals are onerous with so many LE chiefs refusing to sign, and a clear, intentional effort to further restrict gun rights especially when nearly zero crimes have been committed with legal, approved NFA firearms.  However, this administration has never let logic stop it before and frankly, the public and most firearm owners are ignorant about NFA items.  The public and most firearm owners will not come to the defense of NFA firearm owners. Sure hope it doesn't go that way and I will fight it but that's how I see it.

Even though my Cleo will sign I got a trust just so I could e-file. E file  form 1 is supposed to be back up now too.

After doing more research, thats exactly what i am going to do…trust and e-file.  now i just need to go get a few lowers.

Ammo9000,  I'm in Volusia county as well and the SOT I'm using said Sheriff Johnson will not sign for NFA, even for his own Deputy's.
So, I have Form 1 SBR's and suppressors on order with my Trust.

If your interested, PM me for the SOT information. He only charges 10% over wholesale plus 6.5% tax and shipping.
Title 1 transfers are $15 ea. + $5 NICS, NFA are $75.

He was cheaper than going through some on-line stores.  The only drawback is he only files on paper, no E-File. (not that that matters at the moment)
