Hi all. My Dad recently relocated to Palm Bay FL from CT and I was holding his firearms until he got settled in. He is now asking me to have a revolver transferred to him so he can keep it in his car and nightstand until he gets his FL carry permit. Aside from the 3-day wait, is he going to have any trouble taking the transfer since he has only been there a few months? He does have a FL drivers license.
Also, anyone have a recommendation for a good shop down there? I see a dozen or so FFLs in the area, but I'd prefer to send them to a shop he is likely to keep doing business with. |
| He shouldn't have any issues. Florida gun laws are pretty lax. Make sure he keeps the gun securely encased (snapped in a holster OR in the glove box OR the center console OR a case, etc) while it's in his vehicle and he won't have any problems with that either. |

I was told it isn't good to keep your pistol in a glove box or center console in the event you are driving with someone else and get pulled over. If the passenger doesn't have a CWP they can be charged, I'm guessing you need the right cop for this, with a concealed weapon as there is no proof on who put it there. It could be urban legned or BS because I don't remember where I read (maybe here or the Florida Gun Laws book I bought). However, if someone knows better, I'am all ears. |

Read the laws and educated yourself. The law says nothing about being the owner of the vehicle either... just that it is a private conveyance. (5) POSSESSION IN PRIVATE CONVEYANCE.—Notwithstanding subsection (2), it is lawful and is not a violation of s. 790.01 for a person 18 years of age or older to possess a concealed firearm or other weapon for self-defense or other lawful purpose within the interior of a private conveyance, without a license, if the firearm or other weapon is securely encased or is otherwise not readily accessible for immediate use. Nothing herein contained prohibits the carrying of a legal firearm other than a handgun anywhere in a private conveyance when such firearm is being carried for a lawful use. Nothing herein contained shall be construed to authorize the carrying of a concealed firearm or other weapon on the person. This subsection shall be liberally construed in favor of the lawful use, ownership, and possession of firearms and other weapons, including lawful self-defense as provided in s. 776.012. |

From the law you posted: Nothing herein contained prohibits the carrying of a legal firearm other than a handgun anywhere in a private conveyance when such firearm is being carried for a lawful use. Again, INAL, but that seems like you shouldn't conceal a firearm in your car--and I don't mean on your person while in the car. I'm not being argumentative just don't like running afoul of any laws. |

Long guns can be anywhere because case law says by size they are not readily accessible for immediate use. SBR's have not been tested in court. Handguns can be anywhere so long as secured/encased etc. |

Yeah, other than a handgun = you can carry a handgun, and nothing in this statute prohibits carrying anything else when it is being carried for a lawful use. IE rifles, shotguns, etc. |

That's incorrect information; don't worry about it. Also; there is no "3 step rule" either. Simply placing the firearm in an unlocked center console or glove box complies with the Florida Statutes that requires it to be "securely encased" as does having it in a closed, but unlocked, pistol case, cardboard box, or pistol rug that is not situated on your person; but according to federal law, without a state concealed firearms and weapons license you don't want to be within 500 feet of a school. |

Why did he not just bring it with him? i bet because he had to drive though NY, and/or NJ and MD... all three will pinch you for it.. They could give a rats ass about federal law allowing it. Many people flying around the northeast get flights diverted into NJ/NY and get pinched for a pistol not on there state license. Federal courts have ruled air travel doesn't count. People just don't the hassle of being jammed up for bs. Living in the northeast makes people very gun shy no pun intended about weapons especially pistols. lesson learned is to make sure all these dumbass liberals moving south are told to shut up and fit in or move back to the northeast where they belong. |

This. We hear too many stories about police in states surrounding CT ignoring FOPA and making folks traveling with guns sort it out in court. Not worth the $25-$50. I ended up using Liberty Firearms. |
