Pretty much the same reason the machine gun ban of '86 can't be challenged for the reasons many wanted...Rep Charlie Rengel (D-NJ) RAMMED the MG ban through without a real vote tally...he just "deemed" that the ban "passed" when really, it may not have.
"let it go" were the famous words uttered by him on CSPAN camera...meaning "just let it pass, who cares about the tally." The courts will never touch procedural issues of the legislature...they should though if it clearly breaks the formal procedures. And this is NOT a precedent...since this lawsuit ONLY challenged the legislatures procedural bullshit...the wrongful use of the message of necessity... |

No i don't but it just set a president that the legislative branch can ram laws through at whim of Asshat cuomo and there is zero recourse for it. This can become the norm now. It is well settled in NY case law that the opinions of the Governor and the legislative leaders as to the need for a message of necessity are not subject to judicial review. Once again all Cuomo did was authorize the message of necessity and neither the Senate or Assembly were required by law to act on it. You are also forgetting that the NY legislature is the most dysfunctional legislature in the US. Contrast the New Hampshire Legislature which requires that if requested a public hearing at the committee level must be conducted as well as a committee vote and up/down floor vote for every bill introduced by a legislator. The entire legislative process in NY is controlled by the two legislative leaders in secret and behind closed doors. By the time a bill is scheduled for a floor vote in either the NY Assembly or Senate it has in effect already been passed in secret conference meetings. The floor debate if any is just meaningless posturing by the member's and the actual floor vote is merely a formality. |
