Becky and I filed an Informal Declaration of Marriage over 10 years ago.  To file a Formal Declaration and go before a JP, do we just need to complete the declaration and have it filed?

I tried looking it up and just got more confused.

We may not have much time to do this.

I think you need to go to the county tax assessor's office and get a marriage license first...  Then you can either go to a JP or have someone who is ordained marry you.  FWIW, it is not difficult in Texas to get legally ordained to marry people.

Heck you can get ordained on the internet in a few minutes. My sister got ordained and performed the wedding for my other sister.

I think they are flip-flopping on the others wedding in September.

Kind of a facepalm moment for the whole family.

I believe that there is a 3 day waiting period on the marrage license.  I.e., once the license is issued, you cannot get married for 3 days.  It was that way 10 years ago and cause me a lot of traveling.

Keep this in mind if things become rush rush.

Thanks for the answers...but it wasn't really what I was asking.

We already have a Declaration of Informal Marriage filed with the county, about 10 years ago.

To get the "marriage license", Formal Declaration of Marriage", can we just file the document for the Formal Declaration..or, will we have to do something different since we already have Informal Declaration.

Time....maybe we have a few months to less than a year.


I never thought we'd run out of time.

Diagnosed with Triple Negative breast cancer Oct 2010.  Bilateral mastectomy March 2011.  Reconstruction Dec. 2011.  Diagnosed with metastatic breast cancer involving liver, bones, and lungs Feb/Mar 2012.  Lung and bone tumors/lesions in remission, liver is now totally involved and unresponsive to the chemo tried sofar, June 2012.

Furty (Sorry 'bout that Furty) Justice,...I'm not trying to throw punches at you or hurt you.  A lot of people on this forum already know what Becky and I are going through, so they knew what I was alluding to in my previous posts.  When I have to explain it (when i should have explained it in the first place), it is much easier for me to be blunt...it kinda detaches me from it,  a third person view.

mm38, sorry to hear about your troubles.  I lost my first wife to cancer almost 6 years ago now.  Cancer sucks.  I hope you are able to keep her as happy and pain free as possible for as long as you can.  If there is anything that I can do for y'all let me know.

See 2.401 and 2.402 of the family code.  If you're concerned about estate planning or community property etc I'd find a family lawyer and get a consultation.   You may also want to ask if there would be any issues with applying for a marriage license since you're already married.  


Sec. 2.401. PROOF OF INFORMAL MARRIAGE. (a) In a judicial,
administrative, or other proceeding, the marriage of a man and woman
may be proved by evidence that:
(1) a declaration of their marriage has been signed as
provided by this subchapter;


Sec. 2.402. DECLARATION AND REGISTRATION OF INFORMAL MARRIAGE.
(a) A declaration of informal marriage must be signed on a form
prescribed by the bureau of vital statistics and provided by the
county clerk. Each party to the declaration shall provide the

Not so much about estate planning, but that is on the list.  

We've already done the declaration and registration of Informal Marriage in Rockwall...about 10 years ago.  Long ago we had decided to do a formal declaration and have a very small(tiny) ceremony most likely with the JP....just never got 'round to it.  I was wondering if the Informal Declaration would cause any additional paperwork or problems with a Formal Declaration.  

I've decided to contact the county clerk as TxInv has recommended.

For the guys that have asked.  Right now she's in one of her good periods, has energy, low pain, eats anything that can't get away from her.  Just started on Xeloda last night, few weeks and a blood test and we'll be able to see if there is any response to the liver metz.  The problem is that with most types of breast cancer, there is a target, most common is a hormone receptor.  With triple negative there is no hormone receptor, so while the primary cancer is typically treated with 3-4 types of chemo drugs at the same time.  If the triple negative breast cancer becomes metastatic, you've got problems.....with most cancers you have a target, metastatic triple negative...try hitting the target when you can't find it or even know what the target is.

To the one that has family currently battling breast cancer.  If you have any questions or need any help, let me know.  And if comes to it, I can carry you.

I'm not help with your legal question, but we'll keep you in our prayers.



Catherine and I got married at the JP after many years of indecision. It was (and is) perfectly fine with us, we were more concerned with each other than with planning what equates to a fancy party for people we don't like , and while we could have certainly afforded "better" it was nice having the extra cash when a car accident, and then the birth of our son, came around.



We hope you get it figured out and have a wonderful ceremony.
