I know that in IL. when transporting a firearm in a vehicle the firearm must be unloaded and cased in a gun case and magazines may be loaded and stored in the same gun case and kept at the far end of the vehicle or otherwize not easily accessible to driver or passengers. How about loaded magazines only when no firearm is in the vehicle? Is there a statute that indicates loaded mags must be kept in one place or another or that loaded mags or ammo may not be kept one ones person? Idunno, i just want to be lawful. Thanks |

Quoted: As long as the firearm is unloaded and fully encased in a case "DESIGNED TO TRANSPORT A FIREARM" the mag can be loaded and in the case with the firearm. - at least on the "case 'designed to carry a firearm'" part. One of my local fun stores talked a local plastic bag manufacturer into making "garbage bag" style containers that measure 16" x 48" out of opaque black poly. They completely enclose the firearm, and are thus legal 'cases' for folks who forget to bring a rifle case with them. Here's the ILCS on the subject: (720 ILCS 5/24‑1) (from Ch. 38, par. 24‑1) Sec. 24‑1. Unlawful Use of Weapons. (a) A person commits the offense of unlawful use of weapons when he knowingly: (1) through (3) snipped. (4) Carries or possesses in any vehicle or concealed on or about his person except when on his land or in his own abode or fixed place of business any pistol, revolver, stun gun or taser or other firearm, except that this subsection (a) (4) does not apply to or affect transportation of weapons that meet one of the following conditions: (i) are broken down in a non‑functioning state; or (ii) are not immediately accessible; or (iii) are unloaded and enclosed in a case, firearm carrying box, shipping box, or other container by a person who has been issued a currently valid Firearm Owner's Identification Card; I know other states often have that language in their statutes, but (thankfully) Illinois doesn't. |

That is the wording in the wildlife code. Might run afoul of the possum police. |

Quoted: Well, DNR in most states is typically more restrictive in the wording of their codes than the states are in their laws, as the former doesn't require as much "to-do" to get enacted.Quoted: Quoted: As long as the firearm is unloaded and fully encased in a case "DESIGNED TO TRANSPORT A FIREARM" the mag can be loaded and in the case with the firearm. - at least on the "case 'designed to carry a firearm'" part. That is the wording in the wildlife code. There is nothing that states you can't have a loaded magazine anywhere in the vehicle. Just make sure you have your FOID on you. Also, be prepared for a very curious cop if he finds a loaded magazine and you say you don't have a weapon in the vehicle. You can't have it in your gun. |

Ammunition transportation is "unregulated". That is directly from the ISP brochure. However, it cannot be transported in a firearm. I was told mags also must not be in the case, but this is untrue.
If a person wanted to take a stand and was willing to be a test case, God Bless! Legally you can have the loose ammo scattered all over your car or trunk. Not really practical. A case or ammo box is the most practical way to transport ammo, lose or in a mag. In a mag, steel GI ammo boxes are probably ideal. Edited because I got caught up in the moment. |

A gun is not a vehicle, and this thread has absolutely nothing to do with a firearm. Once again, there is no law saying where you can or can't transport a loaded magazine in a vehicle. |

Thanks Cody.
The reason I was asking is because if I make a quick trip to the store I might just drop the mag or rounds from my house gun, put them in my pocket and make the run to the store. I got the idea from a friend who had loaded mags in one of the center consol cup holders of his Expadition while our guns were properly stored for transport at the far end of the vehicle. Keeping loaded mags/ammo on your person doesn't seem like it would be legal but its not illegal. Ang. |
