Thats not entirely true bomber. It is thought of as such...but there is a loophole. No one can transfer a Class III device to a person under 21, but the ATF will approve you making your own class III item. It is a little known loophole, and if anyone has questions on it I can elaborate. -Ben |
You could not make a MG anyways...it is my understanding that some places will send you a suppresor that already has all the parts ready, and you just put it together, kinda like assembling you own AR, though I have never seen this personally. And yes, you can request to SBR one of your lowers, but not have a rifle that is already a SBR transferred to you.. -Ben |

Hmmm, I stand behind THEBOMBER.... My cousin(20 y/o at the end of August) tried in March of this year to SBR a AR15 and was denied, NFA branch said that you have to be 21 to legally own NFA items...they explained the law states you could file a application to make one while you were under 21 but once it was manufactured you could not possess it as you have to be 21 to possess NFA articles; by signing the Form 1 they would be making him a criminal the day he manufactured the SBR. I heard the call on speakerphone, we didn't think it would be approved so we weren't suprised when it was rejected. |
The law actually only saws it is illegal for someone to TRANSFER one to your possesion. It might take a few calls to point that out, but it can be done. -Ben |
If it were me, I would not try and exploit some "loophole" in the National Firearms Act or ATF rulings based upon advise I got off the internet. Call/write the ATF and ask for a ruling in writting. Clearly, it is ambiguous at best and IMHO given the specific age restriction on tranfers, the intent is to restrict ownership of people under 21. YMMV...... |

Just a guess, but since you are manufacturing a "new" firearm under the NFA act, specifically the SBR, you are also transferring ownership of the newly manufactured SBR it to yourself which you must be 21 to do so. I wouldn't mess around with an Internet loophole, (btw, there is no gun show loophole is there?), the ATF has double their cases recommended for prosecution in 05, not a good time to be testing loopholes if they existed. As far as the suppressor "kit's"...no way, the ATF already says the collection of such parts is a suppressor by definition. Steve |
