WV State is considering a bill that would limit gun purchases to 1 a day. Now I know this may seem meek, but this is a step. Next 1 a month, year, lifetime.. ect. ect....

I'm looking for a online version of this story, just heard it on the local news.

Let us know if you find anything. I'll be looking for it too. I can't believe that this kind of bill is even being considered in this state. The influx of hippies and people from Maryland are killing us.

Hey!  I'm a new resident in Inwood.  Escaped from NoVA last year.  Is there a list of who voted in favor of this?  How about who introduced it?  I want to make sure I vote against them if they're any of my reps.

SB 102 and HB 2264 Castle Doctrine Act and HB2303 and SB 26 to simplify  the reciprocity process for concealed carry have been introduced this year and should be supported.

Subject: DELEGATE NAME - Regarding H. B. 2375

Delegate NAME,

As a constituent I would like to take a moment to share my thoughts on House Bill 2373, the limitation on purchase of handguns, introduced on January 22nd by Delegate Doyle.    Having read the full text of the bill, I feel this legislation would pose an un-due restriction on the citizens of West Virginia while neglecting to achieve any measurable benefit to the people of our great state.  

In researching the bill, I have found that Delegate Doyle has publicly stated the bill’s goal is to restrict the ability of out of state citizens from purchasing handguns from West Virginia retailers and reselling them abroad for “big profits.”  The wording of the bill itself limits not only those from other states from purchasing multiple handguns, but West Virginia citizens as well. By putting a restriction on the intended “out of state” purchasers and local citizens, it goes above and beyond its stated scope while putting a burden on local firearms collectors and enthusiasts.

As a matter of reducing crime, similar bills in other states have repeatedly shown no measurable effect on crime rates.  The statistical odds of a criminal using multiple handguns in a crime are quite low.  Further adding that the said criminal legally purchased both weapons at the same time is astronomically low, making the bill’s effect moot.  To suppose that there is a white-market arms trade of legal weapons being re-sold for exorbitant profit is equally as far-fetched.  In my experience, most firearms sold within West Virginia are of equal or higher retail price than in other states.  Wholesale prices are also equal among other states, making legal sales for “big profits” unlikely.  The only plausible scenario is the transfer of illegal weapons or transfer of weapons to criminals on the black market is taking place. No legislation limiting lawful purchases will have any effect on a criminal practice such as this, as studies have found that these weapons are typically not purchased legally.

In closing, I must point out that this bill will hinder those of use who choose to legally collect or trade firearms within the state of West Virginia.  Enthusiasts often purchase several firearms within the course of one month in an effort to find one that suites their needs, while selling back those that do not.  This bill would end that practice and put distress on those that enjoy that freedom now.  The same is true of collectors who legally buy and trade firearms, limiting their hobbies and infringing on their ability to enjoy what is now a legal lifestyle. Finally I believe it will impose a burden on retailers within the state of West Virginia, as they will legally be required to deny service to those that purchase even a modest amount of firearms, taking away their business.  

West Virginia is a fantastic state to live in and our firearm laws are limiting enough as is, without the need for further legislation.  I ask that you please take my statements under consideration and that you do not offer any support to H.B. 2375.

A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §61-7-16 , relating to limiting the purchase of handguns to one gun per month; exempting law enforcement, correctional facilities and private security companies from the limitation; providing criminal penalties; and exempting antique firearms from the limitation.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §61-7-16 , to read as follows:
ARTICLE 7. DANGEROUS WEAPONS.

§61-7-16. Limitation on purchase of handguns.

(a) A person who is not a licensed firearms dealer, or a member of a law-enforcement agency or a state or local correctional facility, or a private security company licensed to do business in this state, may not purchase more than one handgun within any thirty-day period. Any person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction thereof, shall be fined up to two hundred dollars or confined in jail up to ten days, or both fined and imprisoned.
(b) A licensed firearms dealer may not sell to any person who is not a licensed firearms dealer, or a member of a law-enforcement agency, or a state or local correctional facility, or a private security company licensed to do business in this state, more than one handgun within any thirty-day period. Any person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction thereof, shall be fined up to two hundred dollars or confined in jail up to ten days, or both fined and imprisoned.
(c) The restrictions on the sale of handguns set forth in subsections (a) and (b) of this section do not apply to the sale of antique handguns.



NOTE: The purpose of this bill is to limit the purchase of handguns to one gun per month. The bill exempts law enforcement, correctional facilities, and private security companies from the limitation while providing criminal penalties. Finally, it exempts
antique firearms from the limitation.

This section is new; therefore, strike-throughs and underscoring have been omitted.

Wow.. I wrote my Rep that email a few hours ago (on a Sunday) and he has already written back!


As a member of the NRA and having a 100 percent voting record of protecting Second Amendment rights in the Legislature for over a decade, I will not support legislation that would infringe on those rights.  I agree with you that this bill is an over-reaction and would do more harm to businesses and law-abiding gun owners than to anyone else.

I'm always glad to hear from constituents and friends that believe in protecting our right to keep and bear arms.
