They are legal. You can have a magazine of any capacity, but if you have more than 30rds in it plus the one in the chamber (31 total) then you have created a " Dangerous Ordnance" which is illegal under Ohio law unless the item is NFA registered. This doesn't apply to .22LR. |
| Been through this several times over at 1919a4.com. Ohio Supreme Court said, even the law says it is total capacity over 31 rounds, it is actually how many rounds are in the magazine while in the weapon that counts. So you are legal with a 100 round magazine as long as you only have 31 rounds in the magazine in the weapon at one time. I know, it is stupid, but that is what they said. |
The ORC (Ohio Revised Code) directly states "...capable of, or specifically adapted to, fire more than 31 rounds without reloading...." To me, this means if you install a mag in the gun with a capacity of over thirty rounds, full OR empty, you are breaking the law (by making capable AND specifically adapting). I am not sure where you got your info, but the Ohio Supreme Court has not updated the ORC to state any different. I if anyone finds where the Ohio Supreme Court has ruled otherwise, please point me in the direction of the case. That being said, i seriously doubt you would get arrested for that alone, but you WILL get charged with it, if you use the gun doing something stupid.
