Hey fellas, I'd like to confirm something regarding HB495.  I
searched all 7 pages of our hometown forum and didnt see an answer but I
feel like it must have been asked here many times before.



Since
this law change, I can legally carry loaded rifle mags with my rifle,
as long as they aren't inserted into the rifle.  Correct?  







I got this from buckeyefirearms.org so I assume its correct.  My main concern is the portion in yellow below.

For
someone who does not have a Concealed Handgun License, that person may
have loaded magazines or speed loaders in the vehicle so long as:




  1. The magazine or speed loader does not fit any firearm being transported in the vehicle; or

  2. The magazine or speed loader is in a compartment reachable only by leaving the vehicle; or

  3. The magazine or speed loader is in a closed package, box or case
    that has multiple compartments (i.e. a gun case) as long as the magazine
    or speed loader is in a separate compartment in the closed package, box
    or case from the firearm, OR, if the closed package, box or case only
    has one compartment, the magazine or firearm is separately enclosed in
    something using a snap, buckle, zipper, button, hook and loop etc. (My
    best stab at this is it is a one compartment gun case, the gun or the
    magazine/speed loader would need to be in some sort of pouch that is
    closed.); or

  4. The magazine or speed loader is on the person of the occupant in a
    pocket that is closed using a snap, buckle, zipper, button or hook and
    loop.


For someone with a CHL, they may have a loaded magazine in the
vehicle anyway they wish, so long as any magazine for a non-handgun is
not inserted into the non-handgun. (i.e. a loaded rifle magazine may be
anywhere in the vehicle as long as it isn’t inserted into the rifle.

If you have a valid CHL, you can carry loaded mags anyway you want except inserted into the firearm.

If you do NOT have a valid CHL, you can carry loaded mags but they must not be carried with the firearm they go to. They can be carried anywhere if the firearm is not present (ie. another vehicle). Or they can be carried along with the firearm as long as they are in enclosed areas not with the firearm (ie pocket, range bag pocket that closes, rifle bag with separate closable mag pockets, etc.)

as crazyelece put it, the law is basically written to confer more leniency in "where" the loaded mags can be stored for CHL holders, vs. non-CHL holders...  ...but, regardless of which of these two "classes" one falls in, you can never have a loaded magazine inserted into the long gun when it's in the vehicle...

No.

They would need to be in separate compartments to be considered "unloaded". Otherwise, it would be considered "loaded".

I notice lower down that you reference 2923.16(k)(5) from the BFA:
(My best stab at this is it is a one compartment gun case, the gun or the magazine/speed loader would need to be in some sort of pouch that is closed.)

You're making an assumption that he doesn't have a valid CHL. If he has a valid CHL he can carry loaded mags anywhere, any way he wants except inserted into the rifle

He never said he did.
