what are the laws regarding ar 15s in new york? are they illegal or not? i can't find anything that says one way or another. |

They are legal as long as the barrel is 16 inches or longer (total including compensator) with a permanently fixed compensator (no flash suppressors), has a fixed buttstock (no retractable buttstocks like the UBR or CRT), and does not have the bayonet lug on the front sight base.
Im in NY too so Ive been doing the research. If you are to order an AR, just let them know you are in NY and they will know what to do. Several different manufacturers for complete rifles usually have a Post-ban model for us New Yorkers, otherwise you can always ask if you're unsure. | Well if you want to get technical, All AR-15s are illegal in New York. The AWB restricts Colt Model AR-15 specifically as well as all coppies or clones of that gun. However, the rule is not enforced, and so stands the precarious balance of gun rights in the state of New York. One day they could very easily turn around and call them all assault weapons and come knocking on your door. Thing is no COP is dumb enough to do that and no DA or CLEO values their life and public order that little to demand it. |

+ Do you really think that the anti-gun factions in NY would allow dealers to sell AR "clones" that they thought were illegal under NYS law?

The ATF (in 1994), and the states of NJ, CT and MA have all stated and/or ruled that postban compliant semi-auto rifles/shotgun/pistols are not clones or copies of weapons that are banned in their respective states or under Federal law when the Federal AWB was still in effect. There is nothing further to discuss. It is a non-issue. New York Legislative Memorandum, 2000 Ch. 189 Memorandum in Support, New York State Senate: Establishing an Assault Weapons Ban in New York Since 1994, federal law has restricted the possession of assault weapons and large capacity ammunition feeding devices. The provisions contained in this measure are designed to ensure that New York State's already stringent gun laws mirror the federal provisions. The bill's definition of an "assault weapon" and a "large capacity ammunition feeding device," as well as the exclusions and exemptions applicable to each, mirror the current provisions of federal law defining and prohibiting activities related to a "semiautomatic assault weapon" and a "large capacity ammunition feeding device" (see 18 U.S.C.ยงยง 921(a)(30), (31) and 922 (v) and (w) and the bill is not intended to prohibit possession of any weapon that is not prohibited by federal law. |
