I just quit a job yesterday because they want us standing for our entire shift except breaks which totals 1 hour out of 8. I expect my last paycheck to be at minimum wage for not giving notice and maybe held until uniforms are turned in but they are withholding my second-to-last paycheck which was to be payed this morning with direct deposit. That pay period was all said and done and they aren't paying. I've sent a message asking why and have yet to receive a response. Can they legally do this when it's not the last check? I'm waiting for a response from them but looking for laws pertaining to this but only find it mentioning the last check which is not for a couple weeks.

I walked out because I was tired of killing my knees for a company that refused to think about the possibility of a raise and kept the pay low.
On another note I finally got to talk with someone who said there was a system crash on tuesday and they had to reenter all the hours info so we should be paid on monday or tuesday next week, if thats the case I can live with that.

i guess I need to quit also.

I work a 10 hour day with only 2 15 min brakes and one 30 min lunch. Other than that I am on my feet all day. I guess I am 35 years to late on quitting.

Shit I should quit because I can get a call 24-7-365  so I am never really off.  I also have to do a bunch a standing and walking.  Hell there are times I go 12 hours with out a beak no longer then it takes to piss.  

Oh wait I like to eat and stay in a house drive a car and collect black things that go bang.  Think I will keep a job.


But no they can't keep your pay .  Call the Texas workforce commission and they will be on them like crabs on a hooker.


Next time give notice it will look better on your work history.

For your info I'm in my late 30's and having a hard time losing some weight, by the way that was just a part time job anyway I have another that pays a little more and has a possibility of a raise. As far as the workforce commission I'm not sure how that will work considering the pay gets transfered from another state, the local office doesn't deal with payment.

Final Wages

Delivery of final wages can be made by the methods listed above.  If an employee is laid off, discharged, fired, or otherwise involuntarily separated from employment, the final pay is due within six (6) calendar days of discharge. If the employee quits, retires, resigns, or otherwise leaves employment voluntarily, the final pay is due on the next regularly-scheduled payday following the effective date of resignation.

If an employee resigns or gives notice they will be resigning, there is no provision in the Payday Law requiring employers to continue to employ the person until the date they intended to resign or to pay them beyond time they actually work.

An employee may be entitled to unused wages for fringe benefits (vacation, holiday, sick leave, parental leave or severance pay) only if the employer provides for these benefits in a written policy or agreement.


Deductions from Wages

If an employee has quit while in possession of company property and is due a final paycheck, wages may be withheld only when the employer is authorized to do so by law, required to do so by a court or has written authorization from the employee for the deduction. Otherwise, the employer would need to attempt to recoup the property by some other means, such as civil remedies (e.g., lawsuit, small claims court or police report) or make arrangements with the employee outside of a wage deduction.

Are you aware that there are people in this world that have a severe medical condition which causes them to be that way? My mother for instance is one of those people. She is a truck driver that has bad knees and a bad back from driving the truck but you probably do not care about that case either. Oh well I am not one of those people I am 6'4" 245lbs and I exercise every day. I would love to see you say something like to my mother in front of me. Probably never happen though you are probably just an internet tough guy. I doubt very seriously you would say that to someones face. Just my thought.What do you think. I never said I couldn't drop idiots like you who misinterpret what other people are saying. I was not making fun of people, others were. I was not trolling you. I was curious as to the reason exactly.  There are better ways to handle it if you know it's coming.  Two weeks notice is always a good thing. 

Walking out on a job implies a lot.  I wasn't there, I don't know your situation.  Walking out on a job, for future reference, tarnishes your rep.

No trolling...in all seriousness.  How are you having A hard time losing weight?  Is there a medical condition?   Are you able to walk?  Have you tried a fitness ap like my fitness pal?  It helps you keep track of calories and excercise.  Bottom line burn more calories than you take in. 

Good luck man.  Hope things get better for you.  Remember when you walk out on a job, it's not just about you or the employer, somebody else has to pick up that slack.  You effect coworkers lives too.
