Actually he is exempt.
Sec 23 (d) A large capacity magazine may be possessed, purchased or imported by: (1) Members or employees of the Department of Emergency Services and Public Protection, police departments, the Department of Correction or the military or naval forces of this state or of the United States for use in the discharge of their official duties or when off duty; The National Guard would be the “military or naval forces” of this state, and it applies when off duty. |
