I thought he ran a warrant check, just like most police do whenever they encounter someone on a traffic stop. He wasn't doing an immigration status check....his dispatch just notified him of a valid warrant. I think he is going to collect some money after his training class.
At the class he is attending, I would ask "I need clarification. Are we now prohibited from running warrant checks on anyone who appears hispanic?" It would be fun to watch the presenter of the seminar squirm while trying to not tell the truth. |

It's sad that I remember a time when that was not the case. I always considered the FCPD as the most professional local PD in the state back in the day. When we would have a riot, they really jumped in and helped us out till the VSP showed-up in enough numbers to take over. |

It was a Federal warrant, Detainers are not entered into NCIC. The agency could/should lose their access.

States that become "Sanctuary States" or that have Sanctuary Counties/cities, etc, should lose every penny of Federal Aid that is aimed at Law Enforcement.
Cancel the "Local Law Enforcement Block Grants" for that State. |

I'm not completely familiar with the deportation stuff, but I thought that an illegal alien that misses a deportation hearing, gets a warrant of removal and deportation issued against them.

View Quote a) Not all jurisdictions and courts word their arrest warrants like and b) verifying warrants via radio is a two step process in which radio informs you of the existence of the warrant and you then have them verify it by contacting the issuing agency who must locate the aforementioned hard copy of the warrant and confirm with the requesting agency that the warrant is still valid and fax a copy to the jail. So charging someone for contempt for failing to comply with the terms of a court document he hasn't actually read but only knows of the existence of through a third hand source is unlikely to go anywhere. Also warrants get unverified and reentered all the time. If you arrest someone in Oregon for a warrant out of Mississippi and they confirm it, but the jail declines to accept the prisoner or the issuing agency decides they can't afford to extradite him what exactly are you supposed to do with dude, convoy him across 24 states you don't have law enforcement authority in and hand deliver him to Mississippi? |
