MINOCQUA - A motion by Kirk Bandstad asking for a new trial and reduced damages has been denied by a judge in Wisconsin. A jury ruled against Bangstad and the Minocqua Brewing Company, finding him guilty of multiple counts of defamation with malice of the publisher of the Lakeland Times, Gregg Walker. Circuit court judge Leon Stenz denied the laundry list of motions, saying it was not the Court’s function to second guess the jury’s decision. Stenz also said he found substantial credible evidence to support the jury’s verdict.

Bangstad failed to appear in court to turn over financial records and answer questions regarding his finances as part of the defamation case in which he was found culpable. Gregg Walker’s lawyer has now filed a complaint for forfeitures involving the allegations of a number of days of zoning violations, some 113 in all, in which Bangstad operated the brewing company in violation of his permit, as well as after his administrative review permit had been revoked. The fine for those violations comes to just over $28,000, not including court costs and legal fees.

The Lakeland Times reports Bangstad’s request for an injunction against the town is due, in Bangstad’s estimation, to retaliatory behavior on the part of the town. Bangstad contends that without that access, his business would suffer irreparably while the court case continues against him. Federal district judge James Peterson cautioned when handing down the injunction that it is temporary, intended to keep the status quo until such time as the legal issues surrounding Bangstad settle.

MINOCQUA - The owner of the Minocqua Brewing Company is facing further legal troubles. A Wisconsin circuit court judge has ruled Kirk Bangstad in contempt of court for failing to appear at a court-ordered hearing. In order to avoid a jail sentence, the judge offered the opportunity to fulfill certain requirements. Bangstad would have to pay just over $6,600 in attorney’s fees by the 23rd, and if he misses the deadline, an additional fine of $200 a day until the full fine is paid. He must also appear and provide all tax returns and financial statements for himself and his business from 2019 to 2023, along with a list of any assets he or his business holds and those that have been sold since 2020. The judge ruled that during the examination of those documents by commissioner Patrick Finlan, Bangstad would not be allowed to invoke his 5th Amendment right unless he states that is doing so upon advice of counsel. If Bangstad fails to comply with any of those requirements, he’ll have to serve four months in jail.

RHINELANDER - Chaos erupted yesterday at an Oneida Co. Planning and Development Committee meeting, which resulted in Minocqua Brewing Company owner Kirk Bangstad being escorted out. Committee members then voted to suspend the Minocqua Brewing Company's conditional use permit for its beer garden for 90 days or until certain requirements are met. These requirements include adjusting the height of the brewery's fence, installing pavers according to plan and paving the parking lot. At a rally ahead of the meeting, Bangstad argued that the county's efforts to shut down his business are a result of his politics, rather than the legitimate enforcement of zoning ordinances. If Bangstad does not fulfill the requirements of the conditional use permit within 90 days, another suspension/revocation meeting will be automatically scheduled. Though the beer garden was ordered closed the store can remain open.
