Their direction from the White House in 2021 was "Find a way to go after guns without needing a vote in Congress" so that's what they've been doing with the full knowledge that their bullshit won't hold up in court.  It allows ATF to say "we tried".

If they enact this "rule", it'll just be slapped down in court like all the others.

They skipped over Prelogar telling the Justices that DOJ, the overseeing agency over ATF, does not receive Chevron deference when criminal penalties are involved.
ATF is going to have some explaining to do, as plaintiffs have brought that concession up in other cases already.

Neighbor who was a dem and outwardly anti-gun secretly had a shotgun. One day he and another neighbor where having a garage sale. Some prospective buyer came and was asking the one neighbor if he had any guns for sale, he did not. Guy wonders across the street to the anti-gun neighbor. Neighbor said he had a shotgun he would sell. The buyer knew there was a new law that all sales had to be made through an FFL. The buyer asked the neighbor to back date the sales receipt to read as if the sale was made before the law went into effect and the neighbor did it. Well it was a set up and the neighbor was arrested for the illegal sale. Several thousand dollars in lawyers fees later he avoided prison.  

If you are randomly selling you just never know who the buyer really is.

I don't know if that makes the .gov look better or worse. If the guy has issues with other things, have the health department or whatever deal with that. Using bullshit laws and drumming up bullshit criminal charges is some Stalinist levels of statism.
