Good morning everyone! 2 pages overnight! Read most of it, I appreciate all the information and help! I have started a account on creditboards.com, will be posting there in a moment.
I pulled my credit report as the last time was in April, had a score of 680, now it's 703, that feels good! I started with 450 oops, it's been a long journey. There's nothing on there about HSBC Best Buy. Only negative account left on there is my student loan which is supposed to clear as current sometime this month. I really need to get going back on the road to be good on my appointment time. So I will respond back later today. To those that said I should be responsible and pay for it. That is what I'm doing, just need to figure out the right people to give the money to and that's why I came here to get some help what to do. However with my recent discovery this morning is that it seems that I do not have a account with HSBC. So now my next step is to get that issue resolved. Again I must go. Good day! |

Never confirm any information with a random stranger over the phone. Tell them they need to send ALL communications through the mail via certified mail, you will review and get back to them via mail.
Sounds like your typical ambulance chasing debt collector. Simple solution, pull your credit file from the big three and see if BB has you down for an unpaid debt |

They could send the serving paperwork to the post office and the court would set a date even if he didn't know about it. I deal with small claims all day long. People purposely serve random addresses because the date is set and if nobody shows up, notified or not, boom... instant judgment. What does a judge do when he finds out the process server lied? |

First I skipped some of the middle of this thread .
I listen to too much Clark Howard . How old is the debt ? Never pay a dime or give any banking information until you have a deal in writing . When and if you get a deal read the fine print . They will settle for less they payed less than .20 cents on the dollar for your debt . |

I once got my wages garnished over a $1K debt on a Capitol One card. They apparently attempted to serve me papers to an old address. I had no knowledge of this until I was contacted by my jobs payroll company.
I was so pissed. I paid off my other credit card and all my debts and haven't touched credit since. Fuck that shit. |

He said that someone was suing someone and needed my statement. I thought to myself if I recalled anyone asking me for permission to get a statement and no one did. He then proceeded and asked if my name was correct which it was. He had me on hold to get paperwork for the statement. Jordan came back, told me my birthdate, which was correct, then told me if my last 4 social security number was correct. I was like how do you have all this information if it's just a statement you need for someone suing someone. He said that he couldn't say anything until I verified the number they gave me was correct. I said it was correct. His attitude changed right there, from there and on he was very demanding and said that they are suing me for a $1,000 debt with HSBC Best Buy credit card. I asked if they are debt collector, he said well yeah sorta but more of a law firm. Then he proceeded to tell me that the judge has awarded them and that they won and I must pay the amount of $1,445.00 today and asked me for my payment information. I began to get more suspicious. I asked him why I didn't get a letter about this first? He said they already did, I said I never got anything. He checked the paper and said it was 2 months ago. I told him I never did receive a letter stating that I must pay or a lawsuit will be made on me. He said let me check with my supervisor. Not more than 30 second he says they will settle with $1,000 if paid today with one full payment. Otherwise if I wanted monthly payments it will be a balance of $1,445.00 instead of $1,000.00. I told him I can't pay that today because I don't have any document in my hands as I'm on the road, I'm a truck driver. He said it's all legal and that the account was handed to them by HSBC and that I should pay today to avoid lawsuit. I started to get confused there as he said he won the suit, now saying there will be a lawsuit if I don't pay today. Finally I told him that I will not pay a penny until I get a proof that I owe that debt to you via mail. He started to get agitated and pushy trying to get me to pay today and more threats on lawsuit as we went back and forth about the importance of needing a document before paying anything. He was also like let's save us both the trouble by making payment in full today. I told him give me the account information and I'll contact HSBC to verify this. He was like if you let us make out a agreement that you'll make payment in full on Monday 12/14/15 then we'll allow you to discuss with HSBC but we guarantee you they will tell you that it's Michael phillips and associates that is working with them to collect this debt. So I told him fine and gave him my email to send the copy to me. Now I have until Monday the 14th to figure this out. I did alot of research on the "firm", can't find much with searching Michael phillips and associates, it only comes up to a medical doctor, so I tried phillips and Cohen associates, found some information on that, doesn't look good. Yeah they bought your account for probably $100. They're legally entitled to pursue it. You can cut a deal for super cheap and it'll go away. Getting a letter of satisfaction from them will be tough. Been there on medical bills, and it sucks. Nothing like added stress to your heart problems.
They can and will serve you papers, (ask me how I know.) you need to respond (most people do not.) to avoid it going to court (in which you don't have to be there for them to pass judgement.) and they will garnish your wages and you will have a judgement on your credit. I talked with a lawyer on mine, first thing they will ask is the amount, most will tell you if its not over 5k to just call the collector and arrange a payment plan, if you are paying they cannot continue to pursue you. Otherwise your legal fees will outweigh the debt in question. I recommend just calling the debt collector and talking to them, they can be reasonable to deal with if you keep your cool. Remember it is better for them to avoid paying for legal resources as well. Good luck. |

People tended to pay their debt or better yet, not borrow money for wants instead of needs in the first place. It really is too easy for people to skate on loans that involve useless shit they don't need to live. |

I had a debt collector call me over a Beat Buy account. Got really shitty with me. I told them I never had a BB account to have fucked up in the first place. He talked shit and said they would sue. I told him I never had a BB account, it's not on my credit report so he could go fuck himself. Never heard from them again.

Sounds like a scam that was reported being run around here this year. Scammers calling phone numbers to find someone who feels guilty and pays them money.

Seriously though, it seems like a scam. I would get a hold of HSBC and have them comb their records. The basic customer service rep can search anything within the statute of limitations. At AMEX I could see accounts even after they were sold off to debt collectors. I couldn't do anything with them but I could confirm that they existed and we're sent to a debt collector (and give the contact info). |

So with some past mistakes I made, I've had my share of run ins with these debt collectors as well.
I had one summon me to court. A deputy from the county sheriff's office came to my house and gave me a packet listing court date, names, amounts, etc. I've never had one tell me over the phone that they've got a judgment against me and to pay up or else. I'd say until you hear from your county court, I'd tell that scumbag to pound sand. |

They came after me over $1200. I would not rule them out legit coming after people for any amount. If nothing else, to scare people into paying. A friend and I filed a warrant against a guy for theft by taking over a long drawn out fight over some car repairs - it took all of $20 cash and about 30 minutes at he court house to serve him. I can see the debt collectors being okay with paying that on the chance that they'll get some money out of people. |

In many states, (apparently NOT MN which is 6), the statute of limitations is longer than the 7 year period. Either way, the collection period is based on the States Statute of limitations. And even then, if they file judgement, you still have to respond. |
