I’ll update this thread when I’m at my computer (hate typing long posts on my phone) but sure enough, the sellers took the shed off the property (probably sold it I would imagine) DESPITE there being a specific clause that any “outbuildings and sheds” convey (the section of the contract was titled “Personal Property Included”). We’re one week out from closing and the deal has been all but finalized. It was a very nice shed and was one of the things that attracted us to the property.
And yes, I’m aware that unless a shed is bolted to a foundation it’s considered personal property and, unless stipulated otherwise in the contract, doesn’t automatically convey to the buyers, but in our case it was so otherwise stipulated in the contract. And no, these are not the only shenanigans the sellers have pulled. And yes, I’ll be pursuing this. ETA: more background...the sellers bought what was a very nice house and let it go to shit (relatively speaking). The house is only a few years old and they ran the HVAC into the ground so instead of fixing it they put in window units. Window units. In a nice house The actual listing was done with a camera phone and dishes were in the sink, clothes on the floor, etc. Just a total dumpster fire of a listing. Luckily, the home inspector (who we've used many times in the past and paid good money for) told us that they didn't live in the house long enough to do real damage. In the words of the home inspector, "this is a case of owners who should have been tenants." Surprisingly, the only actual damage they caused was to one area of the house and it's being repaired per the contract by a contractor of our choosing (they've already replaced the HVAC). Besides that, it's just stuff like missing faceplates, missing fixtures, etc. A trip to Home Depot and $50 later and it's fine. If they had put maybe 10k in the house (or spent 5 and did some of the work themselves), they could easily be selling this house for 30k more, which is why I want it. I buy rentals and know what to look for in a deal at this point. I'm not going to pretend to be a seasoned expert, but I have used a seller's poor choices to get a killer deal in the past, and this shouldn't be any different. I'll admit I've never had a seller make a fuckup on this level though. I will be doing a day before closing walkthrough just to be sure they didn't fuck anything else up, and considering that they're now in breach of contract I can walk away from this if I want to. At this point though, my first option is to get a check from them for $4k at closing. |

Get an estimate for a similar shed. Double it. Tell them to knock said amount off or you walk.

Check HD and Lowes. Maybe they are hiding it in the parking lot with the others.

Be sure to do a pre-closing walk through the day of closing. That shed won’t be the only thing they take from the property.

We thought that was her way of keeping everything. Turns out she actually thought that’s what it was worth and was upset at selling it cheap to de white debils |

When I bought my house last year the seller (across country) allowed her family members to come in and remove a wired, plumbed, and bolted in air compressor. One of those great big ones. Was a few days before closing. I went to Lowes, snapped a photo of a brand new one ($600) and told the seller I want a check for this amount at closing or I walk.
