Sweet Jesus.... "as purported acting Attorney General" 84. Defendant acting Attorney General Whitaker's appointment violated 28 USC 508(a) as he was not the Deputy Attorney General when Attorney General Sessions resigned. 85. Acting Attorney General Whitaker signed the Final Rule, and because his appointment is unlawful under 508(a), the Final Rule is of no force and effect because acting Attorney General Whitaker has no authority to exercise the powers of the office he purports to hold. Our Gov't is cherry picking what it enforces and that's bullshit. The fact the USG cherry picks WHO is held to the letter of law and who isn't is even more bullshit. |

Give him a minute. I'm sure the DOJ sent a "boss fight" level lawyer for him to argue against, not some paralegal. View Quote View All Quotes View All Quotes |

Relax folks.....I just got word that it lasted little over an hour.
The court will now take time to weigh and measure what was presented.....Unlike TV you do NOT get resolution in 60 minutes. |

Sorry guys. I Argued for about 1 hour. Gov argued for a little bit. I argued again. We left at 457. Started at 3’ish. I really don’t have a feel for the result. She asked good questions. She was very engaged. GOA attorney attended. 3 lawyers for gov were present. I brought in some rubber bands and a pony tail holder and said the atf blessed these conversion devices in their final rule. She was very interested in the rubber band bump stock conversion.

Oh crap now the government knows about pony tail holders!!!!
Good job NOLO what's the next step? |
|
You were there but not alone, so many behind you and thankful for what you're doing.

So a GOA attorney was there? What about the NRA or 2AF? View Quote NRA and SAF weren't present at our hearing. I'd venture a guess they weren't at Stephen's either given they aren't litigating a case in relation to this topic. |

GOA was there *likely* to see how the Government was handling oral argument. They were present at our hearing on the 6th as well. They have a hearing on the 6th of March for their case up in Michigan. NRA and SAF weren't present at our hearing. I'd venture a guess they weren't at Stephen's either given they aren't litigating a case in relation to this topic. View Quote View All Quotes View All Quotes Quoted:
