the gov arguments were that this is reasonable, bumpstocks are machineguns, we still don't know if rubber bands are okay. i said, rubber bands are blessed by atf in the final rule and showed them the "alternative 3" which said we could use rubber bands. i said the atf could accept tax payment on these devices if the atf final rule is upheld and they are machineguns. i said only congress has the legitimate authority to regulate this. i said that this should be a 2A case but for the courts not willing to extend 2A protection to MG. what else.... 3 lawyers versus me. i thought the odds were good. i think rubber band bumpstocks are even better than regular bumpstocks due to cost and i let the judge know that i brought in two "bump stock type devices' which the ATF blessed (rubber bands). i argued for a good bit. i'll get a transcript when available.
the most interesting thing. the judge told the gov lawyers that if they plan to do anything with the new AG and ratification of the rule "you should do so sooner rather than later". |

If you've ever wondered what it means to be a good guy, this case is what it means to be a good guy.
We all know congress has the power to ban bump stocks. They banned machine guns and it has held up in court for over 30 years. We're not fighting for bump stocks, we're fighting to make sure the government plays by the rules. In this case, that means the executive branch ought not to rewrite a statutory definition written by congress. The end result is likely to be the same - Congress has the power to ban bump stocks, and if this case of executive overreach fails, Congress may be moved to take action. Even so, fighting to ensure the other players are playing by the rules is a noble cause. If banning bump stocks is what a "MAGA" president does, I'll leave it to the imagination what an antigun president would do given the same power to rewrite the law. |
