Never.

At best SCOTUS will give a very narrow case specific ruling if they ever decide to hear a RFL case. Then the state will tweak the law just enough and it will take another decade or two to worm its way through the courts. A bunch of lawyers in robes aren't going to save you.

There is another side to this.

Let's say you get red flagged and after it's all said and done you're cleared but now your finances are ruined and your life is in a shambles.

If someone felt like they had nothing to lose at this point...I'd suspect that reprisals against suspected rats would be forthcoming and would be spectacular.
