Well, not to show how badass I am or how willing I am to shoot another human being when it is completely avoidable. That's for sure. If I can avoid killing someone I will and have.  I have no bloodlust or fantasies of seeing blood and hearing my firearm go bang.

Sometimes like in this particular case I don't feel the need to follow the 11th commandment of " stand muh ground ".

Say what you want about the father/son shake 'n bake duo, but they did just what they said they would.  The son shoulder mounted that shotgun and let him have it.  Dad backing up the son, son backing up the dad.  Not the best shoot, but I wouldn't convict them of murder.

I didn’t assume innocence. I assumed guilt on all sides. I still think that the father and son duo are just as guilty. It’s not their job to be the neighborhood trash patrol. If they felt the need to take weapons out there then they shouldn’t have been there in the first place. Like I said assholes. Everyone of them.

In TX you aren't supposed to display a handgun in plain view of another person without it being secured by a holster. That is, unless you are trying to prevent another use or attempted use of unlawful deadly force. So if he strolled around the alley with the pistol out trying to impose his own will with the garbage situation, he has already committed a crime (brandishing). They're going to have to argue that his conduct was immediately necessary to prevent against imminent harm. And given the info we have so far I think he can make a case (orange t-shirt guy is probably unbalanced), but I don't think it is a strong one.

All this is, is a case of two dumbasses colliding. Neither one was right.

The defense is likely going to argue that the shooters were in fear for their lives and didn't even know how to respond to the levels of aggression they were faced with.  That guy was WELL off the rails prior to the antagonizing.  I did cringe when I heard him telling the guy to take a swing.

That guy was WELL off the rails prior to the antagonizing.  I did cringe when I heard him telling the guy to take a swing.

As impressed as I am with your ability to let your bosses treat you like shit without walking, I'm a Marine and have been on the receiving end of some pretty substantial ass chewings.  If you can't understand the difference between getting cussed out by your boss and encountering an emotionally unstable retard in the streets then I really can't help you.

edit:  Yeah, that guy was clearly in fear when he was saying "Take your swing."  Your inability to read body language and catch verbal cues doesn't change that.

Dead guy had mental health issues. I've never heard of Intermittent Explosive Disorder, but I'd bet money he's got multiple assault priors in his criminal history based solely on his response to the two armed tele-chubbies.
Wife admitted he was armed with a baseball bat and threw at them after threatening them with death.

I seriously doubt they are getting convicted of murder.
I could easily see them getting off completely.

Class A Criminal mischeif

7 thefts

civil/family/probate
3 evictions
1 protection order

The old guy
Assault w/ deadly weapon in '77 (Reduced to minor level)
2 felony charges of theft in '79 (Dropped?)
unlawful carrying of firearm in '79 (dropped)
retaliation (I can't find whether these charges stuck or not).

Well, not to show how badass I am or how willing I am to shoot another human being when it is completely avoidable. That's for sure. If I can avoid killing someone I will and have.  I have no bloodlust or fantasies of seeing blood and hearing my firearm go bang.

Sometimes like in this particular case I don't feel the need to follow the 11th commandment of " stand muh ground ".

But, you be you and if the big bad man has shit running down your leg you do what you think you need to do.   Don't walk away and let karma or the police deal with him, just shoot him and change your life forever if you think it's worth it.
I too go out of my way to avoid confrontations, but I don’t think the father/son acted out of the bounds of the law.  I would no bill them if I were on the grand jury.

Good that TX is a grand jury state if you are a defendant in this case.

Prosecutor can present what he wants to the grand jury in the way he wants to present it.

Prosecutor doesn't own the grand jury's no bill.
