This is tyranny plain and simple. I highly doubt any of these ruling will every be reversed of heard by the SCOTUS.

Sadly Trump will most likely go down in the history books as the man that gave the tyrants the keys to the kingdom with this ridiculous bumpstock ruling.

We are one bad election away from these abusive powers being used to not only take our guns, mags and ammo but almost any property that Gov wants with the stroke of a pen.

A shit storm of biblical proportions is brewing.

Usually,  in these chicken little court decision threads, I read the actual decision and find out the sky isn't falling. Well, I just read that decision. The sky's falling,  folks. That decision, if it stands, is the groundwork for confiscation without compensation.

The rationale that the government can take property that it deemed legal yesterday because it deems it illegal today without paying you a dime as long  as it advances public safety can be applied to your single family house (or farm) as easily as it can be applied to a bumpstock. But you'll have a nice apartment in the new building or a job on the collective farm,  comrade, so it's all good.

Well, as has been said many times before, there's a reason the socialists not only want, but need, a disarmed population. Their agenda, when it's revealed and people truly understand what it's going to mean, is going to be a lot more unpopular than it is now. Some people will invite the socialist boot to their throat. All we have to do is look to Venezuela to see where we will be in 20 years if we are dumb enough to let the democrats see their toxic vision to completion.

If your town is burning down and the fire department dynamites the houses surrounding the blaze to create a fire break to save the rest of the town, the 5thAm doesn't require compensation.

If (God forbid!) Florida has another outbreak of Citrus Canker and (just like last time) the state cuts down, uproots, and burns every citrus tree within 50 miles of the most recent infection, the 5thAm doesn't require compensation.

If a bunch of jihadis are holed up in a warehouse shooting at the police and firing mortar shells into the city, and the Sheriff burns the warehouse down and kills the BGs as they flee, the 5thAm doesn't require compensation.

If Lord Humungus and his army are headed for Smallville on the only road into town and the Sheriff piles the entire inventory of the John Deere dealership on its sides to establish a defensible roadblock, the 5thAm doesn't require compensation.

That is the exception the judge is relying on. It covers reasonably necessary destruction or taking of private property in response to an immediate threat to public safety, not takings pursuant to legal or administrative policy.

More to the point, federal police power extends only to very limited areas, e.g. maritime jurisdiction and federal property. That's why almost all federal crimes require a nexus to interstate commerce or taxation. The federal government has no general power to criminalize burglary or murder.

Apparently the key word in the exception cited is "dangerous".  We lost our AR ban appeal based on the judge ruling they are extra dangerous in his opinion.  Admittedly omitted applying "strict scrutiny" to the 2nd which will only happen at the Scotus level.  Commies legislating from the bench.

Not trying to attack here, but I have questions . Your post comes off as a huge amount of guardhouse lawyering .

I may not own the paper bill itself , but i do own the value it represents.

When they confiscated gold , the people were reimbursed the value of that gold .

I thought The Fed wasn’t a government agency ? If it is not then the actual paper money isn’t government property either correct?

I’d love to know how many people kept their gold and said fuck the government.
