Information to Pending NFA Forbearance Applicants Submitted Pursuant to Final Rule 2021R-08F
On January 13, 2023, the Attorney General signed ATF Final Rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces.’” Those possessing firearms with a stabilizing brace that were classified as short-barreled rifles under the Final Rule had until May 31, 2023, to file an ATF Form 1 application to register the firearm in the National Firearms Registry and Transfer Record (NFRTR), or to take other action. The NFA Division processed most of the ATF Form 1 applications it received but stopped when required to do so pursuant to Federal court orders. Ultimately, due to challenges under the Administrative Procedure Act, Final Rule 2021R-08F was set aside nationwide and has not been enforced.

Even though it was set aside, individuals who filed an ATF Form 1 application pursuant to Final Rule 2021R-08F may desire that the NFA Division process their application and effect registration in the NFRTR. This may be the case for numerous reasons, including that firearms with stabilizing braces are regulated under State law and registration in the NFRTR provides an affirmative defense to unlawful possession of that firearm. Other individuals may have installed a regular shoulder stock, anticipating that their firearms would be registered. Consequently, ATF will begin processing the remaining applications beginning Wednesday November 12, 2025, unless those who submitted the ATF Form 1 applications provide notice to ATF that they do not want their applications processed.

For those who want their firearms to be registered: No further action is required by you. ATF will process your pending application.

For those who do not want their firearms to be registered: Those who filed the ATF From 1 application via eForms should log into the system and withdraw the application. Those who filed a paper application should notify ATF that they wish to withdraw that application by sending an email, including applicant name, firearm description and serial number, to mailto:[email protected] stating that the application is withdrawn. Any action to withdraw an application must be completed by Monday November 10, 2025.

It is very far from clear that the lawsuits to strike the NFA in light of the tax reduction will be successful.  It sounds like a good argument, but it is always and uphill battle.

I know several who did the form 1 and nothing happened. Most were guns that you would want as a factory sbr, sig 556, HK sp5 , colt commando etc.
they will probably be happy to get them.

I think this sounds like it should put an end to folks saying the tax forbearance means they aren't really SBRs since there isn't really a stamp and they will just make them illegal once the final rule lawsuits run their course.  The ATF seems to be completely convinced they are on the registry and by adding the stragglers to the registry, any argument that this is going to be undone would have a pretty high legal hurdle.  The point is, if something happens with these, there will be plenty else going on with anti-2A actions that are a lot bigger.

Now let's hope all this is just a waste of time after the lawsuits run their course.

That was never going to happen and was one of the stupidest collective mind-fucks in my entire tenure at AR15.com.  Watching members gleefully non-hoping (but so very hoping) other members get fucked over for "bending the knee", (while they themselves wear kneepads all day everyday) was disgusting.  Resulting in a lot people being convinced not to grab a good deal in front of them.  Fortunately it's back on Jan 1 for everyone on everything; which is even better.

Will the suits to then make NFA an illegal non-tax win, and cause NFA to go away?   I doubt it, but hope so.  The more likely trajectory is the NFA and tax remains, and goes up to $10,000 over the next 10 years.

I recommend to have a plan for 2026, regardless, and get it done.

Agree, but even with the tax eliminated next year, the engraving requirement remains.  The FreeBR situation was unique.  I was able to register my SP5K without having to engrave it which was pretty cool.  Of course, if the whole thing goes away, then that will be a huge victory.

I have a Super Duty lower I'd like to FreeBR without engraving.  I think it wouldn't be eligible since I purchased it post 41F though and thus never did the paperwork.

It’s closed/done…

Unless you submitted the Form 1 within the period, it will not happen again. Need to Form 1 and engrave… if after 1/1, then you don’t need to pay $200.

I did 6 guns under the rule; 2 Anderson builds, PSA AK, PSA build, PTR MP5 and S&W M&P15-22.

Other guns were done post that time period… well, minus my TAC-14 but still paid/engraved. And I got BS for doing it on guns I already planned on SBRing. “Your approvals are nothing once the rule ends.” Guess what? I still have approved SBRs… same as the stamped SBRs, SBS and suppressors.

I was able to get three SBR's registered for free under the rule.  I would have eventually paid $200 to get each done, so the only thing that really happened was the ATF missed out on $600.  The best part is that all three were never available as factory SBR's and I didn't have to add U.S. parts to the two imported ones.

Yeah, I didn't have that one before 41F was published.  I did rush out that same weekend and buy an AKV ahead of the rule being published in the register so that I could get a free stamp on that.  Also got several of my other builds done.  Maybe 4-5 overall?

I only did one - a shorty 9mm AR build. Kind of wish I'd have done my Glock in case I ever want to throw it into a chassis, but so it goes. When I was submitting the one I did, I was half thinking "This isn't going to work anyway, but what the hell..."
I don't know what will happen, or if anything will happen. But if something does, I'd rather be the guy with a gun than the guy without one.

Don't feel too bad.  The dirty secret is chassy systems for pistols may look cool, but are actually just awful.  Pistol recoil is designed to be absorbed by the rotation in your hands.  Lock that whole system in a chassy and that slide recoil will jump like a kangaroo every shot.

Must've been. I submitted it right before the deadline (what was that, like May of '23?) and never heard a peep until a few weeks ago when they sent out an email that they were going to start processing them.

This is a interesting development.

When i started this thread i never imagined people would be so divided about it. I submitted my paperwork and got "stamps" (approved forms) and everything was fine. But i know some people were left in limbo a little. Hopefully it all works out for you guys.

I appreciate you doing so.  This thread is how I caught wind of the FreeBR program and I took full advantage.  I already have NFA items, so I was already on the “list.”  

I’ve just had a few more pop in the last few days that were in injunction limbo.

Finally!   Got mine back yesterday Sunday at 1:00pm. This is my first outside normal business office hours approval.  It does say approved with conditions just like the others.  

I had originally submitted five forms in February 2023.  Four of them came back all together after about 40 days.  This last one just sat and sat for some reason.  After the court ruling put approvals on hold i described it as being stuck in atf purgatory.  

As mentioned by many this has definitely been an interesting thread topic with all the different opinions and interpretations.  Have to say its been one of my favorites to follow.

Man, I was under the impression they weren’t approving ones submitted under a trust, so I submitted all mine as an individual.  Thankfully with the tax going away, it shouldn’t be too much trouble (i.e. money) to transfer them into the trust.

No, but try “Ask an expert” and ask if you can resubmit.

Before the processing stopped for braces, they were letting people resubmit via paper F1 (only), but idk if that’s still an option.

They are not allowing resubmission or any reconsideration of a disapproval despite the fact that the examiner based the disapproval on a faulty ajudication.  You can fill out 100 applications identically and get 99 approvals, but if one reviewer dislikes how you fill in a single block, you're out.  Their policy is once there is a disposition, there is absolutely no reconsideration.  It doesn't matter if the examiner was an idiot and made a mistake, they won't do one single thing to help.  They even admit that different reviewers may  make different dispositions despite forms containing identical information.  The answer is ALWAYS resubmit.

Ah, so this explains why ATF suddenly cut loose the "free" SBR applications they were sitting on.     I've heard of a couple others who suddenly and inexplicably got their approvals recently.    
I never got any such email from ATF, but last week I did get approvals on the two applications I submitted in January, 2023.
About 2 years ago, I gave up on the whole stupid mess and dismantled both guns.   I suppose I could reassemble them, if I still have the parts, but I really no longer much GAF either way.

Feb 2025 It’s 48 to 0 and we’re only 2 minutes into the first quarter
trobertson5-0 I wasn't put in jail for what I did. I was put in it for what I think. There were FBI agents posting in my threads. I've seen the discovery showing this.

When I received the approval emails, I went into my gun room and saw that the SBR Elves had magically put stocks on all the pistols I had submitted.

I just got my approved amnesty Form 1 in the mail. I had to resubmit it in July 2023 because I messed up the serial so I had to mail in the corrected paperwork.

I just got denied because of the new rules coming Jan 1. I don't see any reason why those new rules would prevent them from processing this, but I assume I have no recourse, right?

I've seen the system down before when they're implementing new rules - in this case, it's probably taking the fee off the application and any associated changes.

There is a thread in the General NFA tab of all the submissions starting at midnight eastern time on the 1st. I even saw one approved already and one disapproved.

Soneone needs to sue the ATF to make a form 1 SBR with no address engraving since they allowed all of these.
