He was doing it for charity.
But like the Force, there are two sides to this story. On Sunday, 50 miles east of Atlanta, a man spent the night in jail for dressing like a Star Wars storm trooper. The charges: wearing a mask and reckless conduct. WMAZ-TV reports Justin Marling's full armor and plastic gun created concern as he walked down a road in Newborn, population 700. The Jasper County sheriff's report said deputies thought Marling's weapon could be real. Marling said he was only trying to raise awareness for a charitable cause: Star Wars Force for Change, which aims to inspire people to have a positive impact. Wearing a mask in public is illegal under Georgia law, with some exceptions, such as holidays and special events. Per WMAZ: According to the incident report, when deputies pulled up, Marling had two hands on what they thought was a real weapon. They told him to put the weapon down, but Marling turned away and continued walking. Deputies gave a second command, and it was at that point Marling put the gun down and took a step back. When I first started in LE, there was a traffic citation for having an offensive bumper sticker. That eventually got stricken down due to 1st Amendment violations. Jasper County is pretty rural too. Doubt many of them even know what Star Wars is. I'd be surprised if the deputies made over $30K too. |

Wearing mask, hood, or device which conceals identity of wearer (a) A person is guilty of a misdemeanor when he wears a mask, hood, or device by which any portion of the face is so hidden, concealed, or covered as to conceal the identity of the wearer and is upon any public way or public property or upon the private property of another without the written permission of the owner or occupier of the property to do so. (b) This Code section shall not apply to: (1) A person wearing a traditional holiday costume on the occasion of the holiday; (2) A person lawfully engaged in trade and employment or in a sporting activity where a mask is worn for the purpose of ensuring the physical safety of the wearer, or because of the nature of the occupation, trade, or profession, or sporting activity; (3) A person using a mask in a theatrical production including use in Mardi gras celebrations and masquerade balls; or (4) A person wearing a gas mask prescribed in emergency management drills and exercises or emergencies. |

I'm not seeing that charging him with 'reckless conduct' fits the statute:
(b) A person who causes bodily harm to or endangers the bodily safety of another person by consciously disregarding a substantial and unjustifiable risk that his act or omission will cause harm or endanger the safety of the other person and the disregard constitutes a gross deviation from the standard of care which a reasonable person would exercise in the situation is guilty of a misdemeanor. It's a handy law. I used it all the time to snatch folks up in the ghetto. They almost always had warrants. Easy arrest, get the Sgt. off your back, and go out of service at the jail for a bit. Win/Win.

Since it was cold and I was in a rush, I didn't remove my helmet when I went inside. Also in line was a cop, who promptly ordered me to remove the helmet. He didn't explain the law and I didn't ask, but I assume it's to deter robberies. |

I find it interesting he was wearing his star-wars costume...including mask....for the purpose of letting people know about a charity based on star-wars.
I wonder if this means that he has a 1st amendment right to wear a mask when it is part of him communicating his message. |
