Confidential affidavits detail reasoning for police raid of Kansas newspaper

MARION, Kan. — The police chief who led a widely criticized raid of a newspaper office in Kansas told
a judge that a reporter there accessed a restaurant owner’s driving record from a state database and
could not have done so without “either impersonating the victim or lying about the reasons why the
record was being sought,” according to confidential court records used to obtain a search warrant for
the premises.

In sworn affidavits that have not previously been reported, Marion Police Chief Gideon Cody also wrote
that the Kansas Department of Revenue had confirmed to him that Marion County Record reporter Phyllis
Zorn had downloaded the private record. The documents provide the first public accounting of the evidence
that was cited to justify the raid.

Zorn confirmed to The Washington Post that she downloaded the record, a process that involves entering a
name, date of birth and driver’s license number. She said she did so to verify information she had received
from a source. The newspaper’s editor and publisher, Eric Meyer, said he does not believe Zorn committed
a crime. He said that the record was accessed for research purposes and that there was no intent to use it
maliciously. “There is no criminal intent,” he said.

Meyer allowed for the possibility that the paper had technically crossed a line by searching the database but
said that “even if it was illegal for us to do that, the police response was like bringing the SWAT team out for
jaywalking.”

Here is the story as I know it. The congressman was holding a meet and greet at the lady's restruant. The newspaper man who had retired from a Chicago News organization, was doing what the democratic propaganda arm does and the restruant owner had the police remove the reporter from the meet and greet. The congressman was unaware and uninvolved in the removal. The newspaper man dug up dirt on the restruant owner and gave it to the city council who was looking at her liquor license renewal. Newspaper man claims he got it from anonymous source, restruant owner claims he pretended to be her to get her record. The restruant owner's dui and driving without a license charges were from 15 or 18 years ago. (Can't remember exactly. Cops got a warrant to investigate hacking/indenty theft. When this blew up the cops turned the investigation over to the Kansas Bureau of Investigation. Despite what Aimless says we don't have State police. Closest to that would be Kansas Highway Patrol. DA withdrew warrant and return siezed items supposedly unsearched. Newspaper man's mother died few days after raid with only her son (who apparently lives with her) present. Not during raid like Aimless claims. KBI is still investigating. They will charge police if it is warranted, they will also charge the newspaperman if it is warranted. There are no good guys here.

Holy crap, what distorted version of reality do you live in?  There are been several posts doing a better, accurate  job at stating the facts than this bazarre interpretation.

"The newspaper owner has already said they want to file a lawsuit.
Any chance that the Institute for Justice might be involved in it?"

"I would love to be involved in it. "
