Funny how many here bury their hand in the sand and say nope it is not going to happen...it can't happen.
Yet would gladly send in $200 for a "Feature" such as a suppressor or a SBR. If you think this will not pass you are fooling yourself. We operate on a common law system, and precedent has already been established that a "feature" of a firearm can be put on the list. "High Capacity" and "Semi Auto" are just a "feature". I can hear the SCOUS opinion now..."The USG is not infringing on the right of the people to keep and bear arms. The government is merely adding additional features to the list of items currently covered under the NFA which has a well established precedence and acceptance among the firearm community." |

So if a person was to decline to participate in this scheme, would the penalties for non compliance be equal to the penalties for drilling a third hole? Because at that point some people might be inclined to say fuck it, in for a penny, in for a pound.
Not me of course, I think guns are icky and gross.

Such an action would require a law passed by the Congress.
If they don't take the Senate and then either have a filibuster proof majority or abolish the filibuster it will not pass. If it does pass into law it would have to be upheld by the Supreme Court, which it wouldn't be unless they pack the Court. That is pie in the sky #$%* for them and if they come right out of the gate with that they're going to use up a lot of political capital in a highly divisive fight during a highly partisan environment going into a midterm election that will be very difficult for them already. What you're looking at is the Biden Administration asking for the world in the hopes that the Republicans who have no backbone will compromise and be able to sell their constituents on accepting some "common sense" gun control measures. Pretty classic negotiation strategy, but it's not going to work. We can hold out until 2022 at which point we'll have the Senate for certain and most likely the House of Representatives back, which at that point there is just no chance an AWB of that like gets out of committee. |

I have a lot of doubts about how they would be able to implement this if it was able to be passed into law and if it survived the many court challenges it would generate. The ATF struggles to process the number of NFA forms it's getting now and there's no way they could ramp up to process millions of stamps even if they had a few years. How are they going to find a feasible way to stamp magazines with no serial numbers as well? They'd also have to deal with mass non compliance in the form of civil disobedience and red states declaring themselves 2A sanctuaries too.
I hate the idea of FJB's whole gun control plan but it seems like they are really swinging for the fences on this and hoping beyond hope, these people are professional liars and they lie to their own constituents and to the rest of us too.... |
