But, that's about semiautos, he sticks to precedent when it is available, Heller said machine guns were not protected and he was only a court of appeals judge ruling on semiautos so he didn't give anything beyond a brief passing mention distinguishing MGs from semiautos in a mechanical sense: "That is in contrast to an automatic gun – also known as a machine gun – which “fires repeatedly with a single pull of the trigger. That is, once its trigger is depressed, the weapon will automatically continue to fire until its trigger is released or the ammunition is exhausted." Alito not signing on is a bit more surprising, he dissented in 1996 as part of US v Rybar that the 1986 MG ban was unconstitutional because of interstate commerce. But today, Alito gives huge deference to regulatory agencies and police/prosecutors, letting them get the job done with conduct that other justices consider to be violations of their rights, and the bump stock ban is regulatory agency changing their definition... No, it means he didn't feel like putting his name on the order as being in favor of granting the request. He and Alito may have both voted to grant the order but if Roberts didn't agree it isn't granted. Or maybe it was Kavanaugh and Roberts voting yes, but Alito said no. We'll never know. Seminole Rock & Sand Co., which direct courts to defer to an agency’s reasonable interpretation of its own ambiguous regulation. Auer is just like Chevron. They're both heinous shirking of responsibility from the judiciary. I'm not exactly hopeful that they'll take up the torch again, as they should, but it's at least nice to see that a case has already make it to SCOTUS. |

I am both heartbroken and in full compliance with the rule.
My heartfelt thanks go out to NoloContendere, SuperMoose, wolfwood, Joshua Prince, and every other member of the legal team, as well as everyone that has supported the fight. The hours put in toward this fight are countless. The cost of this fight, on a personal level, has been great, and the debt owed is greater. Mark LaRue will always have my respect and admiration, but not just for how much money he has raised for this and other pro 2A fights. No, that is too easy - lesser men have raised as much or more money for far less just causes. Mark LaRue changed his position on bump stocks, and for a man to publicly change his position is rare. His change of heart was not because he suddenly saw them as a tactical weapons platform, but he recognized the underlying legal issues and potential for cascading failure to more precious things, and when he saw the potential for collateral damage he was man enough not only to change, but to become the largest fundraiser for the fight. It is so rare for a successful and prideful man to change his position on something so polarizing, and to do so in such bold fashion, that it is both astounding and awe inspiring. I'm spent. The fight is now academic to me. Better men than I may still have skin in the game, but after a year and half I'm all out of hope or answers. |
