The supreme stupidity of trying to stand up for the little guy while trying to portray the rich guy as evil is what gets me.

It is a logical paradox loop...

"Dear small fry John Q Public,

I listened with much empathy and sadness in my heart as your poor dumb broke ass came to our council meeting and you plead with us not to use eminent domain to take your property.

But we did it anyway so go away.   Too bad so sad.   Guess you should have been rich enough to stop us.   Sucker."

Next breath,

"Mr Money Pockets,

How dare you have the nerve to fight us on this issue of vital importance.   Cant you see what we did to those poor people was for public good?    To think that you stand in the way of progress?   How dare you...

Oh and Mr John Q Public, we are now really sorry we took all your property for seemingly no reason.   Dont blame us, blame Mr. Money Pockets."

Yeah at some point the Killdozer or worse will happen when public officials act this way.

Less than a year after his first contact with the water district, Bennett got a local legislator (whose campaign he had supported) to sponsor a bill creating the Lazy W Conservation District, a governmental agency with standing equal to that of the TRWD, in terms of taking land for right of way. It meant that the water district couldn’t condemn his land. When an influential legislator friendly to the TRWD got that agency’s designation changed to one that gave it more power, Bennett got the Lazy W’s designation changed, too, making it again the equal of the TRWD. That standoff still has to be settled by the courts.

Unfortunately your comment is flawed. Yes there is a ban on magazines of over 15 round capacity but there was a grandfather provision and I read often that the law is not enforced and is effectively ignored.

Sure I can't get good deal 30 round magazines but I have plenty and if I really needed more, I could get them.

PS, people please watch the video.  That woman should be run out of office and the state.

But the public understanding of eminent domain is even more retarded.

every single public utility, electric, gas, airports, roads, military bases, sewage, every single motherfucking thing involves a "property take".

there is simply no possible way to run a country without it.

to say we should not use eminent domain is pie in the sky wishful thinking.

well of course you are right sometimes. water lines, sewer lines, power, i guess. but these fuckers also do things like take some guys piece of property because walmart has agreed to build in the area if they can get a specific location and the local gov does it because it increases the taxes collected. thats when things like this demonstrate how a local gov fucks owners of private property.

Then eminent domain laws should be written so as to prevent the gov't from fucking over citizens like they've been doing since... Oh, I don't know, this shit started here sometime in the late 1700's or early 1800's.

Fuck eminent domain. It's been used as an excuse to fuck over citizens for far too long, and it needs to change. Not be done away with, but it needs to be changed to stop gov't overreach.

The property owner is the one racking up legal fees...likely to hold out for more money. The taxpayer is the one getting fucked by his holding out. The government usually offers above market value for property taken via 'eminent domain' proceedings.

If the government wants an easement for a public works project...they'll just condemn it, pay for it and take it. They'll win in the end. The question is: how much extra will this guy cost the taxpayer?

Staff attorneys still cost them money.  And there are many more associated costs with fighting the issue.  It is also costing the county government to find alternate ways to meet the demand for water.  As for condemning the property, I see you didn't bother to read the back story on the whole issue.  They can't condemn it because he was able to successfully lobby for a water district to be created equal in power to the one trying to exercise eminent domain.  This will have to be settled in the courts and it appears that the property owner has the cash, motivation, and time to do so successfully.

I swear, you sound just like that city council woman in the video.  The land owner isn't costing the taxpayers a red cent.  The obstinance and corruption of the county's water district is the one who created this mess. I don't fault the land owner one bit for fighting to keep what is his and utilizing every legal means at his disposal to do so.

I have had land taken and I have been around and worked with city's when they took land.

Its all about money, it is all about money,  its all about money , it always is about money.  But first it is about private property rights.

City's, ALL CITYS, waste the shit out of money but when they need your land they want to take it for next to nothing.

Young people please understand this land is the only real investment and you only rent it from the state yet millions of people have died for it and the minerals and water under it.

Most of these problems can be solved by money more money.  After all it is your land .  You bought it, you pay insurance on it and you pay taxes on it , it is yours.

If they want it they need more money.

It is wrong to steal land at taxable value.

ED is always wrong to build a commercial tax base.  Well we can make more money with your bay front property.  You just have a house on it if we take it and build a casino the government can make 1000 times more in taxes.  For a power plant maybe for a casino hell no.

My childhood home in La had a city water line running through the backyard and everyone else's yard on the street.  Over the years they had to work on it.  They'd tear up fences swingsets etc and when they were done they'd replace everything.  It seems like the City is trying to use ED because they can.  An easement I can see but ED to take the land seems like over kill.
