When I first started in LE, there was a traffic citation for having an offensive bumper sticker. That eventually got stricken down due to 1st Amendment violations. Jasper County is pretty rural too. (b) This Code section shall not apply to: (1) A person wearing a traditional holiday costume on the occasion of the holiday; (2) A person lawfully engaged in trade and employment or in a sporting activity where a mask is worn for the purpose of ensuring the physical safety of the wearer, or because of the nature of the occupation, trade, or profession, or sporting activity; (3) A person using a mask in a theatrical production including use in Mardi gras celebrations and masquerade balls; or (4) A person wearing a gas mask prescribed in emergency management drills and exercises or emergencies. |

I'm not seeing that charging him with 'reckless conduct' fits the statute:
(b) A person who causes bodily harm to or endangers the bodily safety of another person by consciously disregarding a substantial and unjustifiable risk that his act or omission will cause harm or endanger the safety of the other person and the disregard constitutes a gross deviation from the standard of care which a reasonable person would exercise in the situation is guilty of a misdemeanor. Slightly off topic but in a debate about the Burka/Niqaab this reporter had a discussion with the minister if he could wear a balaclava on the street. De minister said that it was completly legal to do so and he tested it.
