I know "shall not be infringed" but with the way NJ laws are he caused his own problems and could've easily won this on appeal.


NJ man sober for 30 years loses appeal after gun permit denied third time over alcoholism

An East Brunswick man has been denied a firearms license for the third time because of his admission that he was an alcoholic, despite his claims that he has been sober for more than 30 years.

A state Appellate Division ruling on July 17 upheld a Superior Court ruling that the man be denied the license. The man had originally appealed the East Brunswick Police Department's denial of the license to Superior Court.

Court papers say the man, who said he belongs to Alcoholics Anonymous, and who MyCentralJersey.com is not naming for this reason, checked off being an alcoholic on the gun permit application, a factor in the repeated denials.

The East Brunswick Police Department's background check also revealed an eight-day period in 1992 when he was reported to the police three times, according to court papers.

All three reports involved domestic incidents with heavy drinking and suicidal threats leading him to be checked into a hospital, according to court papers.

He applied for a gun license in February 2022 but was denied because of the three incidents along with his admission that he is an alcoholic.

According to state law, alcoholics are unable to obtain a gun permit unless they obtain a certificate from a state-licensed medical doctor, treatment provider, psychiatrist or provide "other satisfactory proof" affirming the severity of that alcoholism won't affect the handling of a firearm.

His first appeal was rejected in Middlesex County Superior Court in 2023, leading to the appeal to the appellate court.

The man contested that his 31 years of sobriety is "satisfactory proof" that he could handle a firearm safely, but admitted alcoholism is "a lifelong disease that could not be cured but only controlled," court papers say.

He also claimed he was only an alcoholic "for AA purposes" because he is required to admit it, but he failed to show proof of consistently attending AA meetings or to present testimony from his sponsor whom he claims he talks to once a month, according to court papers.

He also failed to produce a certificate from a doctor, treatment provider or psychiatrist, and he did not refute the details of the three incidents more than 30 years ago.

The appellate court then determined that after admitting to a disqualifying feature   alcoholism   on his application, he failed to produce "sufficient" proof he was no longer suffering from this, affirming the previous ruling.

The court also acknowledged that the man had "not only a history of alcoholism, but mental health treatment and suicidal ideation" and he provided no medical evidence suggesting he doesn't pose a threat to public health, safety and welfare.

They'd be real pioneers if they were equitable to the people harmed by the AWB and mag bans instead.

Anyhow, I finally got my permit to carry to the other day. Here's the timeline:

June 11 - Applied early in case the fees went up. They didn't go up but I didn't mind because I also wanted to get rid of the restriction on my judge issued permit.

June 12 - Paid in person at the police department.

July 17 - Interviewed on the phone by a police officer. He asked me the same questions that were on the application.

July 22 - Got the approval email.

Right after I downloaded the pdf of my permit, I placed an order with Chad at NJ Liberty Cards  for a plastic card of my PTC. The card arrived in the mail two days later on July 24. That's what I call quick service. The card is nice as well and now fits my wallet unlike the paper permit I was originally issued.

I did laminate my original permit after trimming the paper as much as I could but it looked horrible and the lamination eventually started peeling. This time I went with the plastic card because I wanted my permit to look official and not like something cooked up by a kid in his mom's basement.

Target ammo will get you in the ball park and then use your carry ammo for the final zeroing of the optic. When I first tried zeroing my optic I was simply placing the butt of the gun with the magazine on the bench in the port. I shot 5 rounds that way while trying to get a zero. That's when the range safety officer took pity on me and brought over a pistol sighting rest. Once he showed me how to use it, I was able to zero the optic with only 4 rounds. After that my rounds were all hitting the X ring. The RSO jokingly told me to take the target home and hang it on my front door to keep the bad guys away.

Applications for gun carry permits soared in New Jersey after U.S. Supreme Court ruling

One advocate expects applications will climb more after court challenges end

More than 41,300 gun owners applied for gun carry permits in New Jersey in the two years since the U.S. Supreme Court upended gun restrictions around the country in a 2022 landmark ruling known as Bruen, according to state data.

That's 26 times more than the 1,588 people who sought permits in the two years before Bruen, in which the court's conservative majority declared a constitutional right to take guns outside the home for self-defense.

The surge was a fraction of what's still to come, one gun rights advocate predicted. Scott Bach, executive director of the Association of New Jersey Rifle & Pistol Clubs, said some gun enthusiasts are waiting for legal fights over New Jersey's gun restrictions to end.

"When there is a final outcome to that litigation, I expect there will be another surge. There are people who just don't want to go through the intrusion and the trouble for a permit that's only good for two years until they can have full carry rights. There are a lot of people sitting on the sidelines waiting for the moment when unfettered carry permits will be issued," Bach said.

Bach's group, along with several other gun rights advocates, challenged the law New Jersey legislators passed in the wake of Bruen that set wide-ranging new restrictions on gun carry in New Jersey. Both sides argued the issue in federal court in Philadelphia in October and are awaiting a decision.

After the Bruen decision was released, New Jersey State Police Superintendent Col. Pat Callahan said he expected more than 200,000 people would apply for carry permits.

Mary Kenah is policy counsel with Everytown for Gun Safety. She applauded state Attorney General Matt Platkin for putting data on gun carry permit applications online in a public database launched in March because it "helps us to understand where and whom these permit applications are coming from so individuals can work alongside their lawmakers and local leaders to save lives in a post-Bruen world."

"Since the Supreme Court's misguided decision in Bruen, which lowered the bar for who can carry concealed handguns in public, New Jersey has seen a major increase in handgun carry permits," Kenah said. "In response to this troubling increase, New Jersey lawmakers continue to push the envelope, enacting strong gun safety laws and implementing tools to keep our communities safe, especially as the Supreme Court's decision has dangerously widened the list of public places where guns are now allowed."

The database, with deidentified data on gun owners who have applied for gun carry permits since December 2019, offers a peek into who wants to be armed when they leave their homes or businesses.

It shows that residents of Ocean, Monmouth, and Bergen counties account for nearly a quarter of all applications filed since Bruen, accounting for 11,497 applications. Among New Jersey municipalities, Toms River tops the list with 862 applications, with Newark in second place with 845, followed by Vineland (482), Old Bridge (478), and Jackson Township (456). Residents outside of New Jersey applied for 1,989 permits.

White men are the most likely to apply for a carry permit. About 38,500 men applied, compared to 2,800 women. Almost 33,800 applicants are white, nearly 4,900 are Black, 1,381 are Hispanic, and 1,017 applicants are Asian American Pacific Islanders. Applicants between the ages of 50 and 59 represent the biggest age group, with more than 9,800 applications filed.

About 250 applicants were denied, more than half of them due to "public health, safety and welfare" concerns. Others were denied over criminal records, domestic violence charges, falsification, a background of alcoholism, or mental or medical issues.

The New Jersey Monitor asked Assembly Speaker Craig Coughlin (D-Middlesex) about the gun permit application data. His spokesman didn't comment directly on the data but said that Coughlin is "confident" the state would prevail in the ongoing legal challenge to its "common sense" gun restrictions.

"The NRA and other extremist groups have filed challenges to this and other gun safety laws, including limits on assault rifles and prohibition of weapons at political events. We are confident in the State's position in these cases. Regardless, we will not be intimidated or discouraged.  New Jersey has the third-lowest rate of gun deaths in the country because we have stood up to the NRA. We will continue to defend the right of every New Jerseyan to be safe from gun violence," said Chris Aikin, the spokesman.

You need to check it out if you are new to carrying a gun, if you've been carrying a gun for a while, or if you think you are not going to be involved in a self-defense situation. Obviously, nobody wants to be involved in a situation that involves a lawfully and duly licensed or permitted individual to take out their firearm or worse to have to use it in a self-defense situation. It is good to learn how to handle this type of situation before something happens to you. We've all heard the saying that the best gun fight is the one that you don't have. I really didn't pay much attention to my surroundings before I started to carry guns and knives on my person.

The episode I was talking about was broadcast live on June 30, 2024. Schwartz arranged to do an interview with a gentleman whose name is Chris. He was involved in an incident while driving home. With two other cars on the road, he went to pass the slower one. The faster one in front of him jammed on the brakes, possibly to try and get him to hit their car. They pulled up aggressively next to Chris. He went through a red light to see if they were following him. And they were. The guys yelled at him that they had guns, he better watch out, and they were going to kill him. They even threw a bottle at his car. At a stop light where he couldn't keep driving, one guy gets out of the car and approaches Chris' car and tries to open his door.
