Would it be unethical of me to send in my XPS2 that I got used for like $280 and get a refund for MSRP?

I think so

Aw crap, you guys make me regret finding the receipt.
It was in the original box and it looks like I paid $300 for my 512 from an ARFCOM dealer during some kind of clearance sale back in 2005.

I only noticed my 516 doing this POI shift about a month ago, also very dim even with fresh batteries.

Not sure what I will put on my LMT after this gets returned.

Im going wait a while until some here get their refund, Im not about to wait a few months and be w/o an optic.

So you will wait for results here... THEN wait for a few months?

So FWIW, I called EOTech this morning and by way of navigating around their automated phone system, reached a live person who then gave me Mike Krull's name and direct number. Not going to post his number here as that wouldn't be professional or fair to him, but he was pretty helpful. A couple of things:

  • I received a return authorization and sent in my one and only optic - a brand new EXPS3-0 TAN I had purchased only two weeks prior - and it was received and signed for this past Thursday 12/10

  • Mike said this is a huge undertaking and they're doing their best to make it easy for everyone involved; they even worked over the weekend to check-in all of the HWSs they've received so far

  • Mike was aware of much of the web rumblings around a refund vs. a coupon for a credit; he said he doesn't have the time to address every possible piece of incorrect information, so his response to me was that their official public statement referred to "refunds" and that should be the best indication of their intended course of action

  • While he's not directly involved in the issuing of refunds portion (neither is Accounts Payable FYI because I initially started there), he said he hoped it would be no more than "weeks" when I asked whether it would be "days, weeks, or months" for these refunds to reach consumers

Hunting Mike down and bombarding him with emails or phone calls at this point probably isn't going to yield any new information and will only slow the process down for him and others like him who are already working hard to make this right. Hope this info helps.

BTW, for those of you who are overthinking the "what reasoning should I write in my refund request form?", I don't think it really matters all that much. You probably could get away with "Please refund me as part of the ongoing consumer refund initiative" and you'd be good. Here's what I wrote:

"I'm reluctantly submitting my request for a refund as I wanted this particular sight for my M4 CQBR Block II clone build, but cannot be confident that it will remain free from reticle drift or delamination issues down the road. As this is my only home-defense rifle, the sight must be 100% reliable and failure-free for indefinitely. This is a decision I did not take lightly or make in a knee-jerk fashion based on web panic. It is an unfortunate situation all around -  for EOTech, for the gov, and for the public."

I had heard rumor to expect refunds around the first of the year.

Hoping to hear something relatively soon.  My rifle looks naked without my 512. Sent it off on Friday.

How is that easier than saying "we're issuing checks"? Seems like politician talk, and is actually a bit concerning.

If I get an l3 gift card I'm gonna be pretty upset. That's not going to replace my optic with something I can trust.

Meh, I do the same at work, he's not going to take responsibility for saying X unless he handles that aspect. I can't imagine EoTech going through all of this and using the specific "refund" verbiage over and over (including in their direct correspondance with customers) only to turn around and issue gift certificates. What would be the point? To turn a huge PR issue into an even bigger one? Makes no sense.

I actually took it as "I'm tired of getting asked this question, if you read the official statement it clearly states exactly what we're doing."

Pretty sure they're not going to offer unconditional refunds for everybody, then only give them the option to buy another one of the sights they're offering the unconditional refunds for.

Heres a picture of a refund check that was posted on AR15GOA facebook page. After seeing this i am glad I haven't sent my eotech back, gonna wait for others to recieve refunds to confirm first.

Look at the post mark.

L3 has headquarters in NYC, EOTech's are in Ann Arbor, MI.   Return processing is all going through Ann Arbor.  I'm going with "a joke" as another poster said.

And it was mailed from Dallas, TX

There are L3 communications in Rockwall Texas and Greenville Texas which is right near Dallas, just saying...

Wouldn't someone on this forum have received the "gift certificate" as well. How did this one person get it and no one else?

As other have said, BS.

Agreed; it'll be an actual refund. The emailed replies all state a "REFUND", not a credit, certificate, exchange, or anything along those lines. Just be patient - they're going to be getting thousands and thousands of optics back.

I also agree you don't need to overthink your request. Just put that you want a refund due to the known zero shift issues and an amount (or they'll email you back asking for a receipt). They have to have an amount - just give them one in the initial request.

I filled out RMAs for my EXPS3 and my 553 over the weekend.  Now to wait while they wade through the mountain of requests.  I did get my Aimpoint PRO over the weekend, but their dot always looks like a star to me, which is why I went with EOTech for so many years.

Good question. I think what he was referring to was the various pro-2A news outlets that information has been feeding through. For example, here from TTAG.

You're welcome, 223-B. Hopefully we'll start to see those refund checks come in soon. I'll be sure to post any updates (or phone pics of my actual check) when applicable. Personally, I didn't want to send my EOTech in, but then there's the reality that sitting on the fence could result in me being beyond of the window of opportunity to get a refund, so I erred on the side of caution. Eventually they're not going to throw any more money at this and I didn't want to fall into the group that was on the receiving end of that news. Sucks for sure, but I'd rather have the funds to spend elsewhere.

Exactly. What they hell are people putting back-up iron sights on their guns for, if not for such a scenario when an optic is either broken or not available?

Guess they are just for looks.

I got approval for my XPS2 within an hour after submittal today.  I can't understand how someone can keep a optic after the manufacturer openly states that it is a defective design and offering refunds.  More so, for any liability, in the event that you do ever use it to protect yourself and hit anything other than your intended target.

I submitted my 512 at $400.

They did ask my for place of purchase and receipt but there's no way I would have or know any of that.

How about the EXPS2-2 Holographic Hybrid Sight II (HHS II) which includes the G33 3X Magnifier?
Do they refund the whole set or just the EXPS2-2?

If I return my EXPS2-2 then I definitely wont keep the G33 magnifier

For the record the magnifier will work just fine with other reflex sights (Aimpoint, Trijicon, etc).

It appears to be a decent magnifier.

Other people have reported getting refunds on the set. I'd ask for it if you don't want to keep the magnifier.

But it probably is a good magnifier... Stick it behind an Aimpoint.

If you're just going to use someone's random number, why not just make one up yourself?

I submitted mine for $547.17.

Your absolutely correct. But instead of making up a number I used the MSRP on their web site. $579.00 + 9.5% tax = $634
Submitted it 10 mins ago.

Sent 5 of my 7 in today, figured I'd keep 2 mounted up, don't want to be naked

For the record, my oldest is a 2009 newest 2 were 2015

I've never had a problem with any since 2009, but now that it's an admitted failure, I can't risk all 7

I'd be in a hurry to send those last two back at this rate... Either make irons work for now or go ahead and get an alternative optic or two.

Are there seriously some bitch-ass members here laughing and hoping that EOTech owners get fucked on this? REALLY?

What a bunch of twatwaffles. Being force-fed an entire bag of dicks is too good for you. I hope you get transferred to Detroit. I hope you get drunk and cornholed by Bruce Jenner. I hope your finger pokes through the toilet paper every single time. I hope that you step in dogshit every day.

Got my approval for EXPS 3-0 and 553.

Could have raped them but stayed honest for my sake.

I am sad though, that 553 looked bad ass on my Block II clone

Probably use the refund to cover my Black Friday Apocalypse 2015

There are members who seem to think L3 making false claims and selling defective optics = Ethical Merican Way. But asking L3 for a refund and having it granted = Unethical lying dishonest dishonorable crime.

Actions have consequences and EOTech appears to be trying to do the right thing. If that breaks them, then it does.

However, schadenfreude about fellow Arfcommers getting fucked is pretty low on a personal level. Petty little fucktards.

I feel bad for L3... They bought this company without knowing about this bullshit. Now they are on the hook for it.

I hope L3 stays in the rifle reflex sight game... Once they un-fuck things.

My guess is jealousy. They probably bought a different optic they don't like and now they want a different one. So, when they see those sending in Eotechs for full value and able to make that switch they are jealous.

Or they have no idea what loss of confidence in a product with a company admitted design flaw really means regardless of an actual failure.

Yea. I really liked the retical. I'd buy another one day knowing they are under a microscope and most likely new management.
